Based on our meeting of December 18, 2024 at City Hall, submitted herewith please find two (2) copies of the following: • Overall Layout and Site Plan prepared by Arico Associates, last revised March 10, 2025; • Utility Plan prepared by Arico Associates, last revised March 10, 2025; and • Updated Variance Table. When compared to the prior plan submitted for review by the Planning Board, kindly note that the total lot count has been reduced from 16 lots to 14 lots and the number of area variances being requested has been reduced from 54 to 14. As demonstrated by the updated variance table, 12 lots require relief from the minimum front -yard setback and Lots 6 and 7 require relief from the minimum lot width requirement. While Lots 6 and 7 could be configured to be zoning compliant by extending the lots further into the wetlands, the applicant believes the lots make more sense as currently depicted which will result in maintaining as much of the constrained lands in the conservation areas as possible. Recently, I provided you with a copy of a SEQR negative declaration issued by the New Barden, Susan Page 2 of 2 March 17, 2025 York State Department of Environmental Conservation ("DEC") in connection with its environmental review of the applicant's proposed subdivision modification/consolidation. I enclose herewith Part 2 and Part 3 of the EAF that was the product of DEC's SEQR review. By way of correspondence from DEC Regional Attorney, Aaron Love, Esq., dated March 10, 2025, DEC confirmed its position that the applicant's project does not require a freshwater wetlands permit from DEC. Based on DEC's letter and our prior discussions, I understand that the application can now move forward before the City's land use boards. Kindly advise if anything further is needed for the application to be placed on the agenda for the next available Planning Board meeting. Sincerely, B'4^ Bruce D.
