Dear Members of the Planning Board,
I am writing on behalf of Silver Cannabis Company to respectfully request a modification to the
special use permit granted by the Saratoga Springs Planning Board on October 30, 2023, for our
dispensary located at 75 Weibel Avenue. Specifically, we seek to amend the permit to allow for
permanent operation at this location.
Since opening our doors in July of last year, we have been fortunate to experience great success in
serving the Saratoga Springs community. We have operated responsibly and in full compliance
with all applicable regulations. I’m pleased to report that we have had no issues with traffic,
parking, or other logistical concerns.
In addition to operating responsibly, we have also invested in infrastructure improvements that
enhance the area for the broader public. Most notably, we installed a sidewalk extending public
access further down Weibel Avenue to the southern property line. We were pleasantly surprised
to learn how frequently the residents of the apartments across the street use the sidewalk to walk
to our store. It has become a welcomed and appreciated improvement for the neighborhood.
Given our track record, community contributions, and the absence of any negative impacts, we
respectfully ask that the Planning Board consider amending our special use permit to make it
permanent. We remain committed to being a good neighbor and a positive presence in Saratoga
Springs, and we appreciate your consideration of this request.

Involving the premises with tax parcel #153.-1-19 & 166.-2-2 & 30, in the City of Saratoga Springs, on an
application for a permanent special use permit for a marijuana dispensary in the Neighborhood Center (T-5)
District.
In accordance with 6 NYCRR Part 617, the Planning Board classified the action as a Type II SEQRA Action:
• (18) reuse of a residential or commercial structure, or of a structure containing mixed residential and
commercial uses, where the residential or commercial use is a permitted use under the applicable zoning
law or ordinance, including permitted by special use permit;
Having properly noticed and conducted a public hearing on October 26, 2023 as required on the proposed use;
And, upon evaluation of the application based on the City’s enumerated evaluation criteria to ensure that the
proposed use will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City’s Unified Development Ordinance, article
13.4 “Special Use”, the Planning Board issues the following decision on October 26, 2023 (passed 4-0 – in favor:
Torpey, Mayo, McTygue, Morrison):
Issue a temporary (12-month) special use permit for a marijuana dispensary (approximately 1,250 sq. ft.) within
an existing building with the following conditions:
Conditions:
1. The special use permit shall be in effect for 12-months from the issuance of a certificate of occupancy.
2. A waiver from site plan review is granted for 12-months from the issuance of a certificate of occupancy.
3. The existing 5 ft. wide concrete sidewalk along the Weibel Ave. frontage shall be extended south to
the end of the subject properties.
Note: this approval shall expire 18 months from the issuance date unless all conditions have been complied
with and a building permit issued.
