NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION
#20230771
SPA CITY CANNABIS, LLC (FORMERLY EXCELSIOR CANNABIS, LLC)
75 WEIBEL AVENUE
SARATOGA SPRINGS, NY 12866
Involving the premises with tax parcel #153.-1-19 & 166.-2-2 & 30, in the City of Saratoga Springs, on an
application for a permanent special use permit for a marijuana dispensary in the Neighborhood Center (T-5)
District.
In accordance with 6 NYCRR Part 617, the Planning Board classified the action as a Type II SEQRA Action:
• (18) reuse of a residential or commercial structure, or of a structure containing mixed residential and
commercial uses, where the residential or commercial use is a permitted use under the applicable zoning
law or ordinance, including permitted by special use permit;
Having properly noticed and conducted a public hearing on October 26, 2023 as required on the proposed use;
And, upon evaluation of the application based on the City’s enumerated evaluation criteria to ensure that the
proposed use will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City’s Unified Development Ordinance, article
13.4 “Special Use”, the Planning Board issues the following decision on October 26, 2023 (passed 4-0 – in favor:
Torpey, Mayo, McTygue, Morrison):
Issue a temporary (12-month) special use permit for a marijuana dispensary (approximately 1,250 sq. ft.) within
an existing building with the following conditions:
Conditions:
1. The special use permit shall be in effect for 12-months from the issuance of a certificate of occupancy.
2. A waiver from site plan review is granted for 12-months from the issuance of a certificate of occupancy.
3. The existing 5 ft. wide concrete sidewalk along the Weibel Ave. frontage shall be extended south to
the end of the subject properties.
Note: this approval shall expire 18 months from the issuance date unless all conditions have been complied
with and a building permit issued.
