from the determination of the Building Inspector involving the premises at 125 South Broadway in the City of
Saratoga Springs, New York being tax parcel number 178.35-1-14 in the Neighborhood Center (T-5) District on the
Assessment Map of said City.
This being an application for an area variance under the UDO of said City to permit the addition of a wall sign with
halo lit letters on the upper story facing north at the Hilton Garden Inn and public notice having been duly given
of a hearing on said application held from March 24, 2025 to April 7, 2025.
In consideration of the balance between benefit to the applicants with detriment to the health, safety, and welfare
of the community, I move that the following area variance for the following amount of relief:

As per the submitted plans or lesser dimensions, be approved for the following reasons:
1. Achievability by Other Means: The applicant stated that the sign would make the business easier to
find. Based on the berm, trees, and landscaping on the property, a sign at the proposed location is
most feasible to achieve the objective of locatability. The Board notes that the position and frontage
of the building further constrain the applicants options for presenting the business.
2. Undesirable Change: The applicant has demonstrated that granting this variance will not create an
undesirable change in neighborhood character. The applicant presented numerous examples of
similar businesses (e.g. hotels of more than 20 guestrooms) in districts with similar pedestrian and
aesthetic considerations. The Board notes that the linear front of the wall is 26 LF, which allows a
maximum size of 40 SF, while the proposed is 22 SF.
3. Substantiality: The Board notes that the requested variance is considered substantial, but this is not
necessarily fatal to the application due to the mitigating factors described above.
4. Adverse Effects: This variance will not have a significant adverse physical or environmental effect on
the neighborhood or district. The Board notes the height and illumination of the sign may be
disruptive to the neighborhood aesthetic, however this is not necessarily fatal to the application.

5. Self-Created Difficulty: The alleged difficulty is self-created insofar as the applicant wishes to add a
sign above the second floor, but this is not necessarily fatal to the application.

This variance shall expire 18 months following the filing date of such decision unless the necessary
building permit has been issued and actual construction begun as per the Unified Development
Ordinance.
I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning
Board of Appeals of the City of Saratoga Springs on the date above mentioned, seven members of the Board
being present.
