IN THE MATTER OF THE APPEAL OF
from the determination of the Building Inspector involving the premises at 125 South Broadway in the City of
Saratoga Springs, New York being tax parcel number 178.35-1-14 in the Neighborhood Center (T-5) District on the
Assessment Map of said City.
1. Achievability by Other Means: The applicant demonstrated this benefit cannot be achieved by other
means feasible to the applicant. An existing sign will be replaced by a new sign the same size as
existing sign. The applicant feels a smaller sign would defeat the purpose of identifying the entrance
to the hotel for guests.
2. Undesirable Change: The applicant has demonstrated that granting this variance will not create an
undesirable change in neighborhood character or detriment to nearby properties. The new sign will
have the same dimensions, colors, and logo design as the existing sign.
3. Substantiality: The Board notes that the requested variance may not be considered substantial, but
this is further mitigated by the factors described above.
4. Adverse Effects: This variance will not have a significant adverse physical or environmental effect on
the neighborhood or district as it replaces an existing sign with the same dimensions.
5. Self-Created Difficulty: The alleged difficulty is self-created insofar as it is motivated by the desire to
modify the sign to reflect new corporate design standards, but this is not necessarily fatal to the
application.
