The applicant having applied for an area variance to permit construction fences with barbed wire and spiked posts in the General Industrial District in the City of Saratoga Springs and public notice having been duly given of a hearing on said application held on March 3 and 24, 2025. In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare of the community, I move that the following area variances for the following amount of relief: T YPE OF R EQUIREMENT D ISTRICT P ROPOSED R ELIEF REQUESTED REQUIREMENT C ONSTRUCTION OF A F ENCE OR W ALL P ROHIBITED N OT A LLOWANCE OF WITH M ATERIALS I NCLUDING S PIKED P ROHIBITED MATERIALS (100%) P OSTS, R AZOR W IRE, OR B ARBED W IRE as per the submitted plans or lesser dimensions, be APPROVED for the following reasons: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant desires to add barbed wire and spiked posts to their fencing to meet certain security requirements by various federal agencies as part of the nature of their business. 2. The applicant has demonstrated that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. Nearby properties have similar security measures in this district. 3. The board notes that the requested variance at one hundred percent is substantial, but this is mitigated by the following considerations: a. There are other similar security features already existent in the General Industrial District. b. The property is not readily accessible by pedestrians. Accidental interaction with the fencing is unlikely. 4. This variance will not have a significant adverse physical effect on the neighborhood or district. Permeability and water management are unaffected. 5. The alleged difficulty is considered self-created insofar as the applicant desires to construct fencing Page 1 of 2 with prohibited features that does not already exist, but this is not necessarily fatal to the application. It is so moved, dated March 24, 2025. Passes by the following votes: AYES: 7 (G. Simpson, B. Dailey, J. Cohen, C. LaPointe, S. Gaston, O. Maxwell, A. Demma) This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per the Unified Development Ordinance. I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, seven members of the Board being present.
