OF PAGES INCLUDING COVER: 2 + plans PHONE NUMBER: SENDER’S REFERENCE NUMBER: RE: YOUR REFERENCE NUMBER: 38 Oak St. – ZBA Application Revised Area Calcs  URGENT  FOR REVIEW  P LEASE COMME NT  PLEASE REPLY  AS REQUESTED To the City of Saratoga Springs Zoning Board of Appeals: Y Engineering DPC. herein respectfully submits the following revised materials & information for ZBA review of variances requested for proposed development at 38 Oak St. 1) Revised Garage Plans: The garage size has been modified to decrease the overall building coverage. - The depth of the garage has been reduced by 2’-0. - The rear roof overhang has been reduced to 0”. - The side & front overhangs have been reduced to 8”. 2) Revised Plot Plan: The plot plan has been modified to depict the proposed revised garage plans and garage location on the site. As a result of the reduced garage size, we shifted the garage towards the alley to reduce the zoning variance required for the western setback. 3) Lot Coverage Calce: Existing Lot Area: 4, 500 sq.ft. Existing House Coverage: 1,520 sq.ft. Proposed Revised Garage: 560 sq.ft. Total Structure Coverage: 2,080 sq.ft. = 46.2% = 46.5% coverage requested Paved Area & Walks: 850 sq. ft. (+/-) Total Proposed Impervious: 2,930 sq.ft. = 65.1% impervious < 70 % max. allowed 2 4) Modified Zoning Variances requested: a) Lot Coverage - Original variance requested: 48% (8% = 20% relief) - Modified variance requested: 46.5% (6.5% = 16.3% relief) - Requested variance reduced 3.7% b) Min. Side Setback for Accessory Structure - Original variance requested: 3.3’ (1.7’ = 34” relief) - Modified variance requested: 3.5’ (1.5’ = 30% relief) - Requested variance reduce 4% c) Porch roof: 0’ setback to alley (remains unchanged) d) Total side setback: 3.0’ (western setback towards Oak St. – remains unchanged) 5) Original Barn Size: The ZBA requested information about the original barn that had been on the property prior to 2022. Y Engineering reviewed tax information and photos from 2022: - Tax records of 1925 Barn size: 16’ x 19’ (does not include roof overhangs or shed) - Estimated garage with 12” roof overhangs: 17’ x 20’ = 357 sq.ft. - Estimated shed size (from photo): 19’ x 16’ = 304 - Estimated total barn / shed: 661 sq.ft. - Proposed new Garage: 560 sq.ft. = approx. 101 sq. ft. reduction 6) Consistency with the Neighborhood: We believe that the this proposed project is consistent with the neighborhood as the City of Saratoga Springs Zoning Board granted more relief to the property directly to the South of the project site in 2017. The adjacent property has a lot the same exact size as this project. The precedent was set in 2017, not only for coverage variances, but for the use of the property as a (2) family. This proposed project is requesting lesser area variances with no additional dwelling. Denial of the requested variances would appear to be arbitrary in comparison. - Adjacent property: Variance for 50.1% bldg. coverage (25% relief by current standards) - 38 Oak St. Project: Current variance requested = 46.5% (6.5% = 16.3% relief) - Comparison: Current project requires 8.7% less relief than adjacent ZBA approved site It is our professional opinion that with the reduction in size of the proposed new garage and the resulting reduced variances, the requested relief is consistent with the neighborhood, does not have any negative environmental impacts on the neighborhood and does not negatively affect the character of the neighborhood.
