IN THE MATTER OF THE
SUBDIVISION APPLICATION NO. 20230905 OF
COLIN KLEPETAR

Involving the premises with Tax Parcel ID# 165.57-1-60.1, in the City of Saratoga Springs, on an application
for final plat review of a proposed two -lot subdivision within the Urban Residential - 2 (UR-2) District with
the Planning Board who met on January 11, 2023 and made the following decision(s):
In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA short
Environmental Assessment Form Parts I and 11, made a notion to issue a Negative SEQRA Declaration on April
13, 2023;
And, in accordance with the purpose and objectives set forth in the City's Unified Development Ordinance
Article 14 "Subdivision Approval", the Planning Board issued the following decision:
Q Approve final subdivision plat (with revision date 12/26/23) with the following conditions:
1. Final plans shall address all of the technical review comments to the satisfaction of the City Engineers
Office/DPW.
2. The Planning Board shall accept payment of the fee in lieu of dedication of recreation lands for one new
residential lot ($2,000).
The applicant is required to complete the following priorto signing of the final plat by the Planning Board Chair.
• Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on- and
off -site improvements.
• Submit a fee in lieu of recreation of $2,000 for each new residential lot (see condition of approval).
• Submit two (2) mylar and two (2) paper copies of the final approved subdivision plat for signature by
the Planning Board Chair.
• File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as
provided in Article 3, Section 32 of General City Law.
Approval of the final plat expires within one year after the resolution granting such approval unless all
requirements stated in such resolution have been certified and completed per Article 14 of the UDO.

From the determination of the Building Inspector involving the premises at 35Newton Ave in the City of Saratoga
Springs, NY, being tax parcel number 165.57-1-60.1 on the Assessment Map of said City. The Applicant having
applied for an area variance to permit a subdivision to create two parcels, in the Urban Residential (UR-2) District
and public notice having been duly given of a hearing on said application on March 13th and April 24th, 2023.
In consideration of the balance between the benefit to the Applicants with detriment to the health, safety and welfare

City of Saratoga Springs Standard Notes
1. All work must conform to all Federal, State and City Codes, specifications,
ordinances, rules and regulations.
2. The elevation base for the contours and benchmarks are based on the National
Geodetic Vertical Datum, 1929.
3. Applicant must submit a Letter of Credit Estimate for Project Site Work to the
City Engineer for review and approval. Letter of Credit funds must be posted with
the City prior to Planning Board Chair signature on final plan.
4. The Contractor must schedule a pre -construction meeting with the City Engineer
prior to any construction. Construction inspections by a designated representative
of the applicant are required. The cost of the construction inspection is the
responsibility of the Applicant/Developer.
5. All proposed easements or rights -of -way dedications must be verified and approved
by the City Engineer prior to construction.
6. The Applicant must verify that the proposed project can accommodate the turning
movements of any fire truck that the fire department designates.
7. The Contractor must obtain a street opening permit from the Department of Public
Works for any work in the street or right of way of any City street or road or
alley.
8. Contact the Building Inspector for a Blasting Permit, if blasting is required.
9. All points of construction ingress or egress shall be maintained to prevent tracking
or flowing of sediment or debris onto a public right-of-way. Additional erosion and
sediment control measures also apply.
10. All refuse, debris and miscellaneous items to be removed shall be legally disposed
of off -site by the Contractor prior to submission of the As -Built Drawing.
11. No Certificate of Occupancy will be issued until all site work has been completed in
accordance with the approved plans; all disturbed soils or bare ground have been
fully stabilized; and an "As -Built" drawing has been prepared in accordance with
the requirements of the City Engineer.

1. THE FOLLOWING CONCRETE SPECIFICATIONS SHALL APPLY TO ALL CONCRETE WORK WITHIN THE
CITY OF SARATOGA SPRINGS RIGHT OF WAY AND/OR WITHIN THE APPROVAL AUTHORITY OF THE
PLANNING BOARD. ALL MATERIALS MUST BE FROM AN APPROVED NYSDOT SOURCE. QUANTITIES MAY
VARY DUE TO VARIATIONS IN MATERIALS. PLANT BATCH TICKETS SHALL BE PROVIDED UPON
