The applicant having applied for an area variance to permit two signs prior to receiving a building permit for a property in the City of Saratoga Springs and public notice having been duly given of a hearing on said application held on January 27t', 2025. In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare of the community, I move that the following area variances for the following amount of relief: TYPE OF REQUIREMENT DISTRICT PROPOSED RELIEF REQUESTED REQUIREMENT SIGNS PERMITTED PER STREET 1 SIGN MAXIMUM 2 SIGNS 1 SIGN(100%) FRONTAGE TIME OF INSTALLATION OF SIGN AFTER APPROVAL OF PRIOR TO 100% BUILDING PERMIT APPROVAL OF BUILDING PERMIT as per the submitted plans or lesser dimensions, be APPROVED for the following reasons: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant wants to advertise the significance of the project as a means to solicit donations to execute the project, which is still in the design phase. 2. The applicant has demonstrated that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. 3. The board notes that the requested variances are substantial, but are mitigated by the following considerations: a. Although a single parcel, there are two structures, therefore one sign per structure is more congruent with a reasonable interpretation of intent of the applicable ordinance. b. The sign facilitates the design phase of the project, allowing a building permit to be issued sooner than if donations were not received. c. The signs are temporary. Page 1 of 2 4. This variance will not have a significant adverse physical effect on the neighborhood or district. 5. The alleged difficulty is considered self-created insofar as the applicant desires to construct two signs prior to issuance of a building permit, but this is not necessarily fatal to the application. It is so moved, dated: January 27, 2025 Passes by the following votes: AYES: 7 (G. Simpson, B. Dailey, J. Cohen, C. LaPointe, S. Gaston, O. Maxwell,A. Demma) This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per the Unified Development Ordinance. I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, seven members of the Board being present.
