RE: Advisory Opinion from the Planning Board to the City Council—UDO Text Amendment for Short Term
Rentals
Dear Mayor and Commissioners,
Pursuant to City Council action on November I 9, 2024 requesting an advisory opinion from the Planning
Board,this board reviewed the proposed text amendment to the UDO to amend Article 9.5 Accessory
Structures and Uses.
Per the UDO, the Planning Board recommendation and the City Council decision on any Zoning Text
Amendment must consider the following standards (I 3.I 5 E.2):
a. The consistency of the proposed amendment with the Comprehensive Plan and whether the
proposed amendment provides a more workable way to achieve the intent and purposes of this
Ordinance and the Comprehensive Plan.
b. The consistency of the proposed amendment with the intent and general regulations of this
Ordinance.
c. The extent to which the proposed amendment promotes the public health, safety, and welfare of
the City.
d. Whether the proposed amendment corrects an error or omission, adds clarification to existing
requirements, or reflects a change in policy.
e. The extent to which the proposed amendment creates nonconformities.
The Planning Board considered the proposed text amendment at their January I 6, 2025 meeting and issued
a favorable advisory opinion contingent on the following revisions to 9.5 V. Short Term Rental— Residential
(STR):
V. 3. Eliminate the end of the sentence, "and does not change the character of the dwelling unit or
adversely affect the surrounding neighborhood of which it is part". V.3. would read: "Short term rentals are
permitted in a residential dwelling unit as an accessory use provided that this use is clearly incidental and
secondary to the primary use of the dwelling unit for non-transient residential purposes".
V. 5. Change the rental period of a Non-Primary Residence STR from I 50 to 45 cumulative days per each
calendar year. (To ensure that any Non-Primary Residence STR remains an accessory use to the primary
use of the residence.)

Proposed Text Amendments to UDO -STR
Planning Board Advisory Opinion
Add V.9 Short Term Rentals are only permitted in single-family dwellings (including individual condominium
units),two-family dwellings, and three-family dwellings or mixed-use buildings with three (or fewer)
residential dwelling units.
Add V.I 0 Maximum off-street parking for a STR either one parking space per each guest bedroom or the
number of existing, improved, parking spaces on the property,whichever is greater.
This resolution was made by motion and passed 6-0(ayes: Marshall, Pingel, Mayo, McTygue, King,White) on
January 16, 2025
