In the property owner's submission of the 239 Washington Street Land Disturbance EAF, item (5 ) states the project is consistent with the adopted Comprehensive Plan. See the excerpts from the CP, “…. protect sensitive environmental resources and preserve traditional community character…. Support the City’s sense of history and the “City in the Country” by preserving the quality of, and linkages among, cultural and open space resources… Encourage and increase housing diversity and affordability as well as neighborhood vitality. Saratoga Springs’ open space resources constitute a vital economic component and a valuable aesthetic and recreational amenity. It is this unique open space character that creates the ambiance of the “City in the Country.” This project disrupts sensitive environmental resources by proposing development in a wetland area, directly contradicting the comprehensive plan's directive to protect such spaces. Further, on item (14) the owner self-identified the project as both URBAN & WETLAND. This project will clearly then be subject to the new NYSDEC regulations that go into effect on Jan 1, 2025. It is clear the owner and their representatives are trying to rush this development plan through the Planning Board approval in the 2024 calendar year to skirt the new regulations. Excerpt from NYSDEC Urban Wetland Protection Rule, effective Jan. 1, 2025, “It is LOCATED WITHIN OR ADJACENT TO AN URBAN AREA, as defined by the United States Census Bureau as of 2020” Knowing these facts, in good conscience, I urge the planning board to reject this application and/or postpone the decision until a full site development plan is presented and reviewed through the NYSDEC under the new regulations.
