The proposed action consists of rezoning two lots on Nelson Avenue (Tax Map 166.77-4-17.1 &
166.77-4-17.2) from UR-2 to Planned Unit Development (PUD) and to be named the JW Hemingway
PUD.
The two parcels are owned by ANW Holdings, Inc. Both parcels were part of a 4-lot subdivision
which was approved in the summer of 2022. The subdivision included three single family home lots
which front on Nelson Avenue and one larger lot, tax parcel 166.77.4-17.1, held for future
development. A sketch plan for this lot was discussed during that approval process, which is
generally in conformance with the current, proposed PUD Sketch Plan.
One of the three previously approved single-family lots is now included within the PUD Boundary
but will be developed, as originally planned, as a single-family home blended into the character of
Nelson Avenue.
At present, these lots function as a grass/crushed stone seasonal parking lot during the track
season. The project area, currently known as the old Schrade Lot, borders historic racetrack
facilities on three sides. The north and south property lines border NYRA Barns, and to the east
across from Frank Sullivan Place is the paddock area.
The proposed concept plan for the PUD parcels involves the development of eight single-family
homes and a 4-unit mixed-use building. Two of the single-family homes will have frontage,
consistent with the recently approved lots. The other six are proposed on a private Lane with
access from Frank Sullivan Place. Three of the single-family homes will also have detached guest
units. The proposed multi-use building will have frontage on Frank Sullivan Place and will include
three stacked residential units, an efficiency unit for owners’ guests and an approximately 800-
1,000 square-foot commercial space. The commercial space is intended to operate seasonally
during the summer months/track season as an art gallery or tourist retail establishment.
In addition, the project will benefit the community by investing $160,000 to enhance the
functionality and increase the capacity of the Scott T. Johnson Recreation Center by expanding the
existing parking lot; an improvement that has been identified as a specific need by members of the
community.
The development area falls within the Residential Neighborhood (RN-2) Future Development Area
of the City of Saratoga Springs 2015 Comprehensive Plan. This designation is characterized by
single family residential uses with moderate density two -family. While a mix of housing types is
present, these areas retain the basic character of single-family neighborhoods, such as front and
rear yards, driveways and garages. Small, neighborhood-scale commercial uses may currently
exist to complement the residential uses.
The overall development concept is in conformance with the intent of the Comprehensive Plan and
intends to blend the homes on Nelson Avenue seamlessly into the character of the existing
neighborhood and streetscape, including the provision of front porches and set-back garages.
The maximum density in the R-2 district is 7 units/acre. Therefore, 13 units are allowed under the
current zoning and Comprehensive Plan. In addition, UDO Section 13.16, D. Permitted Density,
states, “The maximum density permitted in any proposed PUD, or subsequent amendment thereto,
shall not cumulatively exceed 20% in addition to the maximum density envisioned by either the
current Comprehensive Plan or by the applicable zoning in effect immediately prior to the adoption
of the original PUD, whichever is lower.” Therefore, an additional 20% allows the unit count to
increase to 15 units. The proposed development falls within that density with 15 proposed units.
The proposed PUD also meets the current UR-2 zoning for building and lot coverage. The project
has been designed to create a density that, once landscaped, will fit the surrounding context, feel
private for all the owners, and serve as a valuable asset for the city while providing upscale housing
adjacent to the track.
The current development plan for construction is to break ground in the early fall of 2025, after the
completion of the racing season. The plan is to install all infrastructure, pavement to the base
course and foundations during the first six months of construction. The units would be finished as
they are sold. The market will determine the final schedule, but the goal would be to have the
project completed in three years.

AMENDMENT TO THE UNIFIED DEVELOPMENT ORDINANCE OF
THE CITY OF SARATOGA SPRINGS TO ESTABLISH
THE PLANNED UNIT DEVELOPMENT DISTRICT KNOWN AS
“JW HEMINGWAY PUD”
BE IT ORDAINED , by the City Council of the City of Saratoga Springs, New York,
following a public hearing, as follows:
Section I – Name:
This ordinance shall be known as THE JW HEMINGWAY PLANNED UNIT
DEVELOPMENT and modifies the Unified Development Ordinance (UDO) of the City of
Saratoga Springs, New York.
Section II – Amendments:
The Unified Development Ordinance of the City of Saratoga Springs, New York, (the “UDO”)
and the Zoning Map of the City of Saratoga Springs as set forth therein shall be and the same hereby
are amended by changing the UDO for a delineated segment of the land owned by ANW Holdings, Inc.
(“Applicant”) designated as tax parcels 166.77-4-17.1 and 166.77-4-17.2 on the Inside Tax District Tax
Map for the City of Saratoga Springs, which property is presently located in the Urban Residential
(UR-2) Zoning District for purpose of zoning classification under the UDO. To the extent there is a
conflict in the provisions of the UDO and this Planned Unit Development ordinance, the Planned Unit
Development ordinance shall control.
Section III – Boundary:
The area of the JW Hemingway Planned Unit Development (“PUD”) consists of +/- 1.86
acres and is bounded and described in Exhibit "A" attached hereto and made a part hereof. The tax
map references for the inside tax district of the City of Saratoga Springs are as follows:

Section IV - Concept Plan
The PUD proposal is described according to a concept plan attached hereto as Exhibit
"C". The plan shall be used by the City and the PUD as a guide for all development. This plan
may be changed, altered or amended pursuant to the terms of this legislation and Article 13.16 of
the Unified Development Ordinance of the City of Saratoga Springs.
Section V – Objective:
Planned Unit Developments are intended to encourage and allow more creative and
flexible development of land than is possible under district zoning regulations. It is the
objective of the JW Hemingway PUD Ordinance to develop the parcels, allowing the build-out
to be achieved utilizing a mix of residential housing with a small, pedestrian oriented
commercial component.
The proposed PUD falls within the of the City’s 2015 Comprehensive Plan
Residential -2 (RN-2) Land Use Category.
Section VI – Uses, Area and Bulk Standards:
There shall be constructed within the boundaries of the PUD, single family residential
structures with detached pool houses, garages, and guest rooms, and one multi-family residential,
multi-use building.
The proposed uses are as follows.

Section VII– Access and Parking:
Access to the PUD is proposed from Nelson Avenue and Frank Sullivan Place. Two single
family dwelling units will have direct driveway access from Nelson Avenue. Six single family dwelling
units will be accessed from a private drive connected to Frank Sullivan Place. Three of those single
family dwellings will have guest units detached from the main house . The remining units will be
accessed from a private drive connected to Frank Sullivan Place. The private drive and circular turn-
around will be owned and maintained by the JW Hemingway Condominium Association. The cul-de-
sac will be constructed to a size sufficient to meet fire safety standards.
The remaining first floor multi-family unit along with one single family dwelling unit will have
direct driveway access from Frank Sullivan Place.
Parking will be provided according to the below specified schedule.

Section VIII - Infrastructure Improvements:
The entire project, as set forth herein, will be serviced by the City of Saratoga Springs
public water and sanitary sewer mains. All other improvements shall be constructed in compliance
with applicable codes, rules and regulations.
The internal, private driveways throughout the project will be owned and maintained by
the JW Hemingway Condominium Association.
All infrastructure improvements that are constructed in the City of Saratoga Springs
roadway and right-of-way shall be dedicated to and accepted by the City of Saratoga Springs and
shall be the City of Saratoga Springs' responsibility for all purposes including maintenance and
reconstruction.
Stormwater disposal shall be by means of retention, detention and infiltration systems
constructed on-site with discharge to municipal systems meeting all state and local standards.
Section IX - Construction Standards
Unless otherwise noted in this Ordinance, all City construction standards current at the time
of PUD site plan approval for any project shall be met, with regard to improvements that are to be
made in a public right-of-way or with regard to improvements that are intended to be dedicated
to the City of Saratoga Springs.
All construction standards for buildings and public improvements and for utilities shall be
prepared and approved by licensed architects, landscape architects or engineers. All costs associated
with the construction shall be borne by the developer whether the plans are provided by the City of
Saratoga Springs or by the developer. Further, all completed construction shall be certified to the
City of Saratoga Springs by licensed architects , landscape architects or engineers as being completed
in the manner called for in the plans and shall be certified in accordance therewith.
Section X - Issuance of Building Permit
Prior to the issuance of a Building Permit to develop any or all structures within the
PUD, the applicant shall receive final PUD site plan approval for the structures to be constructed
from the City of Saratoga Springs Planning Board.
It is anticipated that there may be multiple applications for PUD site plan approval as
buildings are designed and each application shall show the relationship between the buildings to
be developed and the vacant area within the PUD. Each PUD site plan shall respond to the
requirement set forth in Article 13.5 of the Unified Development Ordinance of the City of
Saratoga Springs.

Section XI - Municipal Fees
All projects within the JW Hemingway PUD shall be subject to the current municipal fees
at the time of PUD Site Plan approval.
Section XII - Amendments to this Ordinance
This PUD shall be developed in general compliance with the final approved concept plan
as specified in this ordinance. In the event that new lands are proposed for inclusion in this PUD,
the owner within the PUD may seek to extend the boundaries of the PUD area pursuant to this
ordinance. All other amendments hereto shall be amended pursuant to the applicable provisions
of the Unified Development Ordinance of the City of Saratoga Springs or as provided herein.
Section XIII- Time Extensions and Expiration:
The PUD shall expire if a complete application for site plan approval has not been filed within
two years after the date the City Council grants PUD approval. As part of the approval the City
Council may extend this period of time including approval of a phasing plan where
the validity period is longer than one year.
An extension of the one-year period may be granted by the City Council if the applicant requests an
extension in writing prior to the expiration date of the approval according to Article 13.16, 3, g, of the
UDO.
Final site plan approval will expire if a building permit has not been issued within t hree years
after the date of final site plan approval. An extension of this three-year period may be granted by the
City Council if the applicant requests an extension in writing prior to the expiration date of the approval
according to Article 13.16, 4, d, of the UDO.
Section XIV- Validity
If any provision of this ordinance shall be held invalid, the remainder of the ordinance
shall not be affected.
Section XV - Modifications:
The PUD owner may, upon approval of the Planning Board of the City of Saratoga Springs, alter,
modify or change the number, placement and type of structures to be constructed within the site so long as
the alteration, modification and change does not result in an increase in density, and maximum allowable
building and impervious coverage, as set forth in Section VI.

Section XVI - Effective Date
This ordinance shall take effect the day after publication as provided by the provisions of the
City Charter of the City of Saratoga Springs, New York.

To whom it may Concern:
I am writing to express my support for the proposed JW Hemingway PUD
JW Hemingway is a project situated on Nelson Avenue through to Frank
Sullivan. This is the old Schrader lot which now is used to park cars at the track.
This property borders the historic racetrack on three sides. The north and south
borders NYRA Barns, and to the east is the paddock area across Frank Sullivan
Place.
This proposed PUD consists of one lot of the 3 lots that have been subdivided
previously and the remaining lands. The concept of the Witt Construction PUD
is to have the proposed homes on Nelson Avenue fit into the vernacular of the
streetscape and provide homes with front porches and set-back garages. The
interior of the lot will be developed off Frank Sullivan with six single-family
homes. Three of the homes will have detached guest rooms. They'll be at a
separate 3 unit stacked condo building off Frank Sullivan. Within this building
there is a proposed efficiency unit for owners' guest to stay, and an 800 square
foot commercial space for an art gallery or tourist retail that would operate
seasonally during the summer months/track season. The density of the
neighborhood, once landscaped, will feel very private for all the owners and will
be an asset to the city while also providing upscale housing adjacent to the track.
The proposed PUD meets current zoning requirements for density and lot
coverage. Additionally, as part of this project, Witt construction has agreed to
provide $160,000.00 of enhancements to the Scott Johnson Recreation Center.
This is an important Civic Space improvement that will provide additional
parking at the Rec Center which has been a long-standing need for the
community.
