From the determination of the Building Inspector involving the premises at 1 Jefferson Street in the City
of Saratoga Springs,New York being tax parcel number 165.84-2-49 on the Assessment Map of said
City.
The applicant having applied for an area variance under the Unified Development Ordinance of said
City to permit construction of a screened in porch attached to an existing single family home in the
Urban Residential -2 (UR-2)District and public notice having been duly given of a hearing on said
application held on the 18t' of November 2024.
In consideration of the balance between benefit to the applicants with detriment to the health, safety and
welfare of the community, I move that the following area variance for the following amount of relief:

Setback
As per the submitted plans or lesser dimensions,be approved for the following reasons:
1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the
applicant. The proposed screened in porch will have a 10' setback on the north side of the property;
the problem is caused by the fact the home was built prior to existing zoning regulations and is only
1.5' from the property line on the south side.
2. The applicant has demonstrated that granting this variance will not create an undesirable change in
neighborhood character or detriment to nearby properties. Adding the screened in porch will not
block light or visibility for neighbors. The addition will use natural materials and match the design
of the existing structure.
3. The variation is substantial, but this is due to the nonconformity of the building on the south side.
The addition on the north side will not exceed the existing side setback.
4. The Board finds this variance will not have an adverse physical or environmental effect on the
neighborhood. Permeability requirements will meet district requirements as the new addition is
replacing an existing paver patio.
5. The alleged difficulty is self-created insofar as the applicant desires to construct a screened in porch
on an existing nonconforming structure, but this is not necessarily fatal to the application.

Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, seven
members of the Board being present.
