Re: SCPB Referral Review #17-190-Frontage Build-out Variance and reaffirmation
of prior Special Use Permit (in T-5) and Site Plan Review-Askew
Frontage build-out variance now required as a result in the change of development
plan from a 2-lot subdivision to full-frontage development of one 8.42-acre parcel
for construction of two 3-story apartment buildings of 12 dwelling units each and
one bldg of 3 attached townhome units.
Station Lane (proximity of West Ave., Washington St. and NYS Route 9N)
Received from the City of Saratoga Springs Zoning Board of Appeals on November 19,
2018 and previously from the city Planning Board on September 18, 2017.
Reviewed by the Saratoga County Planning Board on November 19, 2018.
Decision: No Significant Countywide or Intercommunity Impact
Comment:
In accordance with the Memorandum of Understanding (MOU) between the City of
Saratoga Springs Zoning Board of Appeals and Planning Board and the Saratoga
County Planning Board, the above referenced area variance, special use permit and
site plan review have been reviewed by staff and with necessary concurrence have
been deemed to present no significant countywide impacts. Italicized below are the
comments originally provided in our referral response letter of October 27, 2017 in
reference to the special use permit and site plan review. Please use these comments
for such local actions that may be generated due to any required resubmissions.
Proposed is the construction of three 3-story apartment buildings (12 dwelling units in
each) and associated parking, sidewalks and infrastructure on an 8.42-acre lot in the
city's T-5 District. The site has 3.49 acres of wetlands with no ACOE regulated wetlands
to be disturbed and the project has a NYSDEC Wetland Permit for impact of the 100ft
buffer area. The project location is in an area known to be "wet" and the site has a
depth to groundwater of 1.5 to 3.0 feet. Twelve percent of the site is poorly drained,

88% is moderately well-drained. Overall site disturbance is limited to 1.81 acres of the
property, with the constraints of existing wetlands and high groundwater minimizing the
potential to fully develop the site. These constraints will also result in a tight envelope of
development that needs to be addressed for the access/provision of emergency service
equipment around the buildings as well as for snow storage on-site or the need for snow
removal.
The project will connect to City of Saratoga Springs water and sanitary sewer with the
indication from the project engineer that both have capacity for usage and will be able to
accept flows. There will be gravity flow from the three buildings to an existing pump
station on Station Lane, but there needs to be verification of the pump station's present
capacity or ability to meet future needs. There is an existing 8" water main on the south
side of Station Lane and 4" water service lines will go into each building.
Stormwater collection will be directed to catch basins and then directed to stormwater
basins (stormwater management areas). There is a drainage course on site, located in
area of NYS DEC wetlands, which we assume will be addressed in the SWPPP to be
submitted/filed.
