Response to ZBA Public Hearing held on July 22, 2019
My name is Richard K. Galarneau, my wife Denise and I reside at 58 Arrowhead Road,Saratoga Springs.
Denise and I were unable to attend the Monday,July 22nd public hearing but fortunately we were able to
view the proceedings via internet. We feel it's important to take this opportunity to comment on
attorney Michael Toohey's presentation in regards to this issue. Mr.Toohey stated that to his
knowledge the building located on Lot#1 of the proposed 3-lot subdivision,the building requiring relief
from the minimum rear yard setback, was built sometime in the mid 1960's. As it may be important, I'd
like to point out that this building was built sometime after it was purchased by Joseph Mutinsky. (Per
deed attached it was purchased February 15th, 1969.) Making the construction of this building
happening no sooner than the fall of 1969 with its completion being in the spring of 1970 at the
absolute earliest. It is very possible and more than likely that it was the following year 1970/1971 that
construction occurred.
A question concerning the status of the "roads" surrounding these lots was asked by one of the board
members. Mike Toohey's explanation was somewhat vague in that he believed the "roads" were un-
defined and only a result of years of use by the neighbors out of necessity that eventually developed
into the roads that exist today. This is a misconception and in need of clarification. All of the "roads"
surrounding these lots, the lots that once belonged to the Hudson Valley Railway, are perfectly and
exactly defined in our deeds and referred to as "driveways". For a specific example please see the deed
to Parcel 192.12-1-36, attached for your review. (This is lot#1 of the proposed 3-lot subdivision.)This
deed states as follows:
James and Elizabeth McCormick hereby grant and release to Joseph and Catherine Mutinsky"all that
certain piece or parcel of land lying and being in the outside district of the City of Saratoga springs,
County of Saratoga and state of New York, designated as old lot#N-14 and new lot No. 11 on a map of
the Hudson Valley Railway Company entitled "Map showing land and sub-division of portion of the land,
Saratoga Lake N.Y." dated January 22, 1923, and filed in the office of the clerk of Saratoga County, N.Y.,
February 16, 1926 in Map case 28" (See map attached).
After the paragraph that describes the lot configuration the deed states:
"EXCEPTING AND RESERVING for use in common with other lot owners or lessees' driveways across said
parcel as indicated on said map."
These driveways are the current roads "right of ways"that give legal and deeded access to all lots
previously belonging to the Hudson Valley Railway Co.These driveways are well defined and not just the
result of years of use by the neighbors out of necessity that eventually developed into the roads that
exist today.
Another recent example of the "driveways" being exactly defined: In 2015,the driveway is identified in
Daniel Wheeler's survey of lot 192.12-1-1/ 192.12-1-48.1 entitled "Lot line adjustment Map, Lands of
Timothy Yates and a portion of the lands of the City of Saratoga Springs" filed February 4, 2016 shows
clearly"the City of Saratoga Springs has conveyed and combined to Timothy Yates"the 25' right of
way"Driveway" as described in all of our deeds.
This 25' right of way"driveway" is also noted on my Dads Survey completed in 1985 by Paul Tommell.
I'd like to point out that this "driveway" is the only legal, deeded access to the Agius property along with
some of the other adjoining properties.
It should also be noted that this "Yates" portion of the 25' right of way"driveway" as shown on the
Timothy Yates survey is not currently in use by way of a neighborhood handshake agreement(in the
1970's)with,then owner Edward Palmer; an agreement to allow Ed Palmer,at his own expense,to
relocate the actual "deeded driveway access"to its current location for the purpose of rerouting vehicle
traffic from passing only a few feet from the side of Ed Palmers home.The current access used today is
labeled as "Tomahawk Lane—gravel road" on Dan Wheelers survey map and is clearly labeled and
located entirely on the private property of Timothy Yates. Because of this relocation agreement with Ed
Palmer, current vehicle access to the Agius property is no longer by way of the defined path described in
the Hudson Valley railway Co. Map or land owners deeds. (Dan Wheelers Survey also attached for your
review).
Is this information important to the ZBA? I don't know! Is there a clear and defined legal access to the
Agius property and in particularly to the newly created lot that the granting of this variance will create?
I believe all of the lots formerly belonging to the Hudson Valley Railway Co. have always been and
should continue to be looked at and treated as individual city lots as if they were surrounded by city
owned streets with their current minimum lot size,front, rear and side yard minimum setback
requirements all applying accordingly.
It was also stated at the meeting that the newly proposed 10' wide lake access easement would result in
the removal of a portion of an existing retaining wall that currently helps support the steep incline to the
lake. History has proven that this incline is unstable and that the retaining wall was placed there by
previous owners of these lots by necessity. Both Lots 9 and lot 8 have experienced their homes lake side
improvements (Decks, piers, footing etc.) eroding and sliding toward the lake.This incline/proposed
lake access area contains natural springs and has sandy, unstable soil conditions. I must ask, is removing
a portion of this existing retaining wall really a good idea? (no matter how small of a portion?) Seriously,
does this proposed 10' lake access easement really provide a reasonable, useable and safe access to the
lake?
Our concern once again remains the same.
This variance and subdivision, if granted, will increase density and will more than likely reduce or
completely eliminated our view of Saratoga Lake. Purchasers of these lots will most certainly define
their property lines by installing fencing or shrubs or trees.They may even, perhaps add a shed or
garage.
The loss of our view of Saratoga Lake will have a major,negative impact on the value of our property.
it will also impact our everyday enjoyment of our property.
I am asking the Zoning board to leave the current lot configurations "as is."
Jim and Pat Agius purchased their income properties knowing what they were purchasing. If granted,
this will have a negative impact on the neighborhood. Its affects will be "forever" having an impact on
our family, both today and in the future.
My wife and!purchased our property knowing the view that it provided and knowing the
configuration of the lots surrounding us. The existing lot configurations should not be allowed to
change now?
I must object to this request for the reasons stated above.
Thank you for your time and consideration.
Again, I ask this question: If the board decides to grant this variance and subdivision, can a provision be
made as a deed restriction perhaps as to the purchasers' agreement to not block or diminish our view by
way of trees, shrubs, fences, structures or any other means?
