I arn an attarney representIlng sarne B�ag M�ado��v Run residents regarding the prop�sed
cc�ns�cfian of a place�f worship far the[]nitarian[Ini�ersalist Congregation at 400 Louden
road �hereinafter"Church").
At the public hearing far the Special Use Permit an l�a�ember 30, 2€}23, this Planning BQard
reeognized that a one-vvay access road alang the City's existing raw water line right-4f-way frorn
the Church prr�perty ta Bog Meadow l�,un, created unsafe canditions at the intersection wit�a Bog
Meadaw Run. The City direct�d the Churc�nat to include this one-way access in their Site P�an
and the applicanY modifietl�heir proposed site�rlan per tl-ie Board's�ire�tion.Now,during the Site
Plan r�view pr�cess, �his Planning Board is requiring a pedestrian path in its place tcr facilitate
pedestrian interconnecti�ity wath the neighborhaod as weil as on-street parking an Bog Meadow
Run to minirnize new on-site�ax�Cing. Further, this Planning Soard is now requiring a significant
reduction in an-srte par�ing and sugg�sting that khe pedestrian pafh will prc�vide access#a o�er�low
�arking an Br�g��advw Run. As di�cussed at the publi�hearing vn 5eptember 26, 2024,there is
still a grave concern regaxding the parking of vehic�es on Bog Meadaw Run, so close ta Laudon
Road wliere the speed limit is 4S mph leading to a blind turn onta B�g Meati�w R.un. Replacing
V�]11C1112.T COI1�1C�5 Wlt�l ��OS�I'1,317 CQI1flIC�S, so clos� to the Bog Meadow l�un intersectian with
Louden Raad is catnpletely unsafe, and there�'ore, waacceptable. Furthermcrre, roadside parking
will impede tw�-way access alang the mnly ac�ess into the neighbarhoad.
In light of these coa�cerns,it is requested the City Engineer re�view this condition and�vnclude the
outcame of thi� pedestrian path and vn-street parking meets all sa���ty requirements befare
requi�ing the change.
O�i a z-�lated matter, the pedestrian path requirement cited aba�e�ias a rnaterial irnpact on the S�te
Plai� that was eor�sidered durin�; th� S�ecial Use Pennit prQcess. In light Qf t11is materiat im�act,
the Special Cl�e Pei-�nit shc�uld �e re�isited and the �'ub1iG Hcaring re-o�cned to enable puhlic
cot�ment assnciated with tliis cl�ran�;e. AS a part af that ��rocess, please also n�te the fnl���Fin�
concern relate�l tr� the ec�mpliance of'the pre�viously issued Speciai Use Permit:

Additioigally, Articl� 16-Consen�atinn Desi�n in the Unified ❑evelnpinent Ordinance states
44Article 16.3 Uses pennitted: C�nly sin�le-f�mily and sigl�le �'ainily attactie�i c�w•ellings are
percnitted witliin a cai�ser�atic�n desigt�."
�ased on the abo�e quoted City af Sar�to�a Sprin�;s Zoning; Urdinance, one would canclude that
a lt�t created pursuaeit to a Canseivatioi3 SuYadivisi�in as is tl�e case in th�40i1 Lnude�i Roa� Pareel,
is limitecl to r•esidential uscs only and the �ption ta pursue a Special Use Per�nit f'or other uses
would �e negated. Special use pennits are an aption for lc�t� in the Rural Residential zone tliat
were N�T created tl�rnugh the Crn�servation 5ubdi�isin�3�rn�ess. This inte�a-etatio�l is rei��forcec�
by Az-ki�le�41-12B (3).
In cc�nclusi+on, the plaruli��g baard r�°as incorrect in permitting tl�e application af a Special Use
Pei-mit fcrr the cnnscrvataon subdi�isio�i at 40(] I�ouden Road. The S�a�ciai Use pennit shauld nc�t
ha�e bee�� considered hased an the currenk z�nin�; nrdinances a� outlined aboVe. We r�spectfully
r�quest that the city attQnley cc�nduct a cc�mpliance re�,�iew af the issuance�f the S�ecial Use;Pcnnit
referenced abor�e and consider rescinding this pei7nit.
