Flansburg 6 Meghan Court Saratoga Springs,NY 12866 from the determination of the Building Inspector involving the premises at 3 Sunrise Drive in the City of Saratoga Springs,New York being tax parcel number 166.14-5-5, in the UR-1 district on the Assessment Map of said City. The applicant having applied for an area variance under the Unified Development Ordinance of said City to permit the addition of a two-car garage and covered front porch to the primary residence in the Urban Residential -1 (UR-1) District, and public notice having been duly given of a hearing on said application held from September 9, 2024 to October 7, 2024. In consideration of the balance between benefit to the applicant with detriment to the health, safety, and welfare of the community, I move that the following area variance for the following amount of relief: TYPE OF REQUIREMENT DISTRICT DIMENSIONAL REQUIREMENT PROPOSED RELIEF REQUESTED FRONT YARD SETBACK 30(24.8' -MODIFIED FRONT SETBACK) 21' 3.8' OR 15.3%RELIEF INTERIOR SIDE SETBACK 12' 9' 3' OR 25%RELIEF As per the submitted plans or lesser dimensions,be approved for the following reasons: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant would like to construct two additions to the primary residence, namely a two car garage and a covered front porch. Per the applicant, alternative designs for both additions were considered,but these designs would not have provided the space necessary to meet the applicant's needs. The applicant considered reducing the size of the proposed garage, but such a change would not have allowed the structure to properly store two cars. The applicant also considered reducing the size of the covered front porch, but a smaller design would have rendered the porch largely unusable. There is no adjoining land available for purchase. 2. The applicant has demonstrated that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. The applicant provided multiple examples of nearby properties with similar two car garages or porches that are Page 1 of 2 situated within required setbacks, none of which pose a detriment to the neighborhood or other nearby properties. The applicant notes that the proposed additions would provide an aesthetic improvement upon the current condition of the property. 3. The Board notes that the requested variance for the front yard setback requirement is not considered substantial. The variance for the interior side setback requirement may be considered substantial, but this is mitigated by the factors described above. 4. This variance will not have a significant adverse physical or environmental effect on the neighborhood or district. Permeability will meet the district requirement. 5. The alleged difficulty is self-created insofar as it is motivated by the applicant's desire to add a two car garage and a covered front porch to the primary residence, but this is not necessarily fatal to the application. It is so moved, October 7th, 2024. Passes by the following votes: AYES: 5 (G. Simpson, B. Dailey, J. Cohen, C. LaPointe, S. Gaston) This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per the Unified Development Ordinance. I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, rive members of the Board being present.
