Susan — In response to an inquiry from the board last night, today I reviewed the 2012 zoning
code that was in effect when our client attempted to get before the board in the 2015 timeframe.
The zoning code did, in fact, have a provision for land disturbance, which was not the
information I provided to the board during the meeting. This was my mistake, and I want to
ensure the record clarifies that there were land disturbance procedures in place that are almost
identical to those in the UDO.
The nuance I did not understand was that the then city planner in August 2015 apparently
advised representatives from Bonacio and LA Group that they needed to provide an actual plan
and that the application was segmented (SEQR) without providing it. This was incorrect
information from the city planner back then, as your city attorney clarified last night in the
discussion pertaining to segmentation.
Can you please forward this correction on to the board and place in the record?
