Project Name Washington St Land Disturbance Activity Project Number 202330378 Project Address 239 Washington St. Comments I grew up in Saratoga Springs and I live with my mom, Lisa Elovich, on Outlook Ave. Access to nature, and the preservation of our community’s ecosystems is very important to myself, my family, and my friends in Saratoga. We hope you will deny this land disturbance request because, not only it is not only contrary to the law, but also harmful to our community. Interfering with the wetlands in the zone of interest will change the character of the neighborhood by degrading the natural spaces that are vital to the wellbeing of our community and our enjoyment of the public spaces. The wetlands in the zone of interest may be covered under 6 NYCRR Part 664, a new law which will go into effect in January 2025. This law that is being put into place specifically to protect small wetlands that are important to the ecosystem. Filling the wetlands in the zone of interest without clarity on whether they would fall under the protection of 6 NYCRR Part 664 would be contrary to the purpose of the law. We respectfully ask that you delay your determination until the wetlands in the zone of interest are reviewed for classification under the 2025 law. Additionally, the land disturbance request is contrary to the law because it is improperly segmented from the broader building plan, which is clearly implicit in the context and nature of the request. This segmentation violates the State Environmental Quality Review Act (SEQRA). Considering only a part or segment of an action is contrary to the intent of” SEQRA. 6 NYCRR 617.3[g]. Here, the land disturbance request should be rejected on the ground that it is segmented from the broader building plan to build either residential or commercial property on the land, thus, it fails to comply with SEQRA.
