HomeMy WebLinkAbout20240614 Lexington Road Subdivision Area Variances Public Comment (2)As per the Fire Code of New York State, Appendix D Fire Apparatus Access Roads, found at: https://codes.iccsafe.org/content/NYSFC2020P1/appendix-d-fire-apparatus-access-roads The following Fire Code makes this proposed development project illegal, specifically because there are already in excess of 30 one-family dwellings with only one approved fire apparatus access road. The proposed development would jeopardize the safety of the whole community by increasing the total number of one-family dwellings by 16 units. Please see the proposed development map attached to the existing neighborhood’s map, followed by the related New York State Fire Code: / APPENDIX D FIRE APPARATUS ACCESS ROADS SECTION D107 ONE- OR TWO-FAMILY RESIDENTIAL DEVELOPMENTS [NY] D107.1 One- or two-family dwelling residential developments. Developments of one- or two-family dwellings where the number of dwelling units exceeds 30 shall be provided with two separate and approved fire apparatus access roads. Exceptions: 1. Construction of dwellings on premises which have had local site plan approval prior to January 1, 2011, with no modification to approved site plan. 2. Where there are more than 30 dwelling units on a single public or private fire apparatus access road and all dwelling units are equipped throughout with an approved automatic sprinkler system in accordance with Section 903.3.1.1, 903.3.1.2 or 903.3.1.3, access from two directions shall not be required. 3. The number of dwelling units on a single fire apparatus access road shall not be increased unless fire apparatus access roads will connect with future development, as determined by the fire code official.
