HomeMy WebLinkAbout20230378 Washington Land Disturbance NYS DEC Letter Sent Via Email March 13, 2024 Beth Clements, PWS LaBella Associates, Lead Wetland Scientist 4 British American Blvd. Latham, NY 12110 bclements@LaBellaPC.com Re: Non-Jurisdictional Determination Request Mohr Service Center Property. TMP #165.14-1-34.1 LaBella Project No. 2230803 Saratoga Springs (C), Saratoga County Dear Beth Clements, The Department of Environmental Conservation (DEC) had determined that there are no DEC regulated wetlands or associated adjacent areas on the above-described parcel in the City of Saratoga Springs, Saratoga County. This determination is based on previous field inspections by this office and materials submitted by the Chazen Companies on May 14, 2014, and confirmed by Kevin Bliss (NYSDEC Region 5 Deputy Regional Permit Administrator), as well as additional review by DEC staff on March 11, 2024. Any wetlands that may be present on the property do not meet the requirements to be mapped by DEC. Therefore, DEC has no Article 24 jurisdiction on this parcel currently. Be advised that changes to Article 24 regulations are expected in January of 2025. Information regarding wetland mapping and jurisdictional determinations may be subject to change when new regulations go into effect. Please note that this letter does not relieve you of the responsibility of obtaining any necessary permits or approvals from the DEC, other state or federal agencies or local municipalities. Sincerely, Beth A. Magee Deputy Regional Permit Administrator BAM:ab
