The following are responses to the comments. Comment 43: The expansion/reclamation of the existing wet pond designated SMP-3 as a P2 variant must comply with the requirements of the SWM design manual(aquatic benches,slopes) water depth, plantings, etc.)Please update the plans and the SWPPP accordingly. The applicant has responded that benches are not required for ponds with less than 4-foot depth. However, the following requirements of the SWM design manual for pocket ponds have not been addressed: a. A document titled "Frequently Asked Questions About Technical Requirements of the SPDES General Permit(GP-02-02)for Storm water Discharges from Construction Activities"issued by DEC in 2004 addresses wet pond depth. The FAQ indicates that the Design Manual requires a minimum 4-6 foot depth for pretreatment and micropools to prevent scouring, and further indicates that the permanent pool does not have a minimum depth requirement but that depths should be no le5s than 3'-4'or the pond will function more like a wetland and should follow wetland design criteria. We note that pretreatment is provided by a bioretention area rather than a forebay„ but it does not appear that the minimum depth requirement for the micropool has been met. The micropool depth and required benches should be provided, or a letter from DEC indicating that the depth and geometry of the pond is acceptable as designed. b. Pocket ponds must interact with groundwater to maintain a permanent pool. Please submit soil testing results that indicate the depth to groundwater within the footprint of the pond and confirm that groundwater is higher than the bottom of the pond. c.A landscaping plan which indicates how aquatic and terrestrial areas will be vegetatively stabilized and established must be provided for all ponds. Aquatic vegetation is essential to the pond design as this is the component Response 43: a. Per discussions with NYSDEC a 3.5deep permanent pool is acceptable. See attached correspondence with DEC. b. The pond currently maintains water at all times and has been confirmed by City of • Saratoga Springs staff. • c. We are in the early stages of a Design Manual update and will plan on clarifying the design criteria to address this issue. Once the Design Manual update is complete, we will also update the FAQ. The question is regarding depth of the permanent pool in the basin, not the forebay. We are proposing a Pocket Pond which will have a permanent pool depth of 3.5'. Based on existing site conditions the pond will interact with groundwater and the permanent pool depth will be maintained. The NYSSMDM does not specify a minimum depth, but the FAQ does reference a 3-4' depth. Also reviewing other states requirements (Minnesota, Georgia, Massachusetts, and New Hampshire) for wet ponds a minimum depth of 3' is recommended. The TDE has asked if we can clarify with NYSDEC if a 3.5' permanent pond depth in a Pocket Pond meets the NYSSMDM requirements. Thanks. Douglas Helier, P.E.
