In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as an Unlisted SEQRA Action: • Upon review of the submitted part I of the short environmental assessment form (EAF) and evaluation of part 2 of the short (EAF); • The Planning Board issued a Negative SEQRA Declaration on July 18, 2024 Having properly noticed and conducted a public hearing on July I 8, 2024 as required on the proposed use; And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the proposed use(s)will not adversely affect surrounding properties and community character; And, in accordance with the approval standards set forth in the City's Unified Development Ordinance,Article I 3.4 "Special Use",the Planning Board issues the following decision on July I 8, 2024 (passed 6-0—in favor: Marshall, Pingel, McTygue, Morrison, Stellato, Ferrante): C� Modify the previously approved special use permit for a mixed-use project (202 I 04 I 5 approved I/27/22 with conditions) as shown on first floor plans dated 7/I I/24 and modified site plan with revision date 7/I 7/24. Condition: • The site plan shall be modified to reflect a total of 47 parking spaces and shall be submitted for administrative action by the Chair.
