I would like to first state I am against any zoning variance to the Stewart’s Marion Ave Property. I have watched and read Stewart’s proposal for a Area Variance for the property on Marion Ave and what I did not see in Stewart’s presentation was how this zoning variance was consistent with the 2015 City Comprehensive Plan since the properties invoked with this variance request is in Conservation Development District (CDD) within the City’s Comprehensive. I would also like to point out that this project would look a lot different, if Stewart did not take advantage of an error when the new UDO was put together from old zoning ordinance. The missing placement of a paragraph UDO opened the door for Stewart to take 100 feet of residential property , which Stewart owns and move it into its commercial property. The ZBA voted against this but Stewart appealed this vote to the court and won it. I bring this up because I believe the ZBA’s vote was correct and in best interest of the city. Let’s not reward Stewart for this error which could set precedent for other projects in city from taking advantage of this error. I truly understand that Stewart has right to use and build on their commercial property but I also know that this is being grandfather under zoning law at time of purchase that would allow this type of use. The Stewart’s project has presented increase the area of this to include the largest Stewart shop in the city, but also adds additional commercial space. Besides working on a SEQR for the zoning board, I would like to see updated traffic study and for a presentation of this project with buildings locat Attach Photo (optional)Field not completed.
