IN THE MATTER OF THE APPEAL OF GM 30 Caroline Street Corp. 356 Arlington Avenue Brooklyn, NY 11208
From the determination of the Building Inspector involving the premises at 30 ½ Caroline Street in the City of Saratoga Springs, New York being tax parcel number 165.60-1-81 on the Assessment Map of said City. The applicant having applied for an area variance to permit a mixed-use development involving Sperry's Restaurant and residential units in the Urban Core (UC) District and public notice having been duly given of a hearing on said application held on the 22nd of July 2024.
In consideration of the balance between benefit to the applicants with detriment to the health, safety and welfare of the community, I move that the following area variance for the following amount of relief: TYPE OF REQUIREMENT DISTRICT DIMENSIONAL REQUIREMENT PROPOSED RELIEF REQUESTED
Min. Build Out Percentage 80% 63% 17% (21.3%)
As per the submitted plans or lesser dimensions, be approved for the following reasons:
1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant wants to expand the current footprint and use of the existing commercial building to include residential units. There is currently a utility easement that would prevent further build out on the frontage along Caroline Street. The Board conducted uncoordinated SEQR and a
negative declaration passed on Monday July 22, 2024
2. The applicant has demonstrated that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. The overall design of the addition will require Design Review Board approval and site plan review from the Planning Board.
3. The variance is not substantial and is further mitigated by the points noted above.
4. The Board finds this variance will not have an adverse physical or environmental effect on the neighborhood.
5. The alleged difficulty is self-created insofar as the applicant desires to add to the existing commercial structure, but this is not necessarily fatal to the application.

This variance shall expire 18 months following the filing date of such decision unless the
necessary building permit has been issued and actual construction begun as per the Unified

members of the Board being present.
