NOTICE OF DECISION
In the matter of the application

Involving the premises with tax parcel #I 9 I.-2-26 & I 9 I.-2-49, in the City of Saratoga Springs, on an application
for Site Plan Review for a proposed approximate 4,000 sq. ft. marijuana dispensary and associated site work in
the Gateway Commercial— Rural (GC-R) District.
In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as a Type II SEQRA Action:
(9) construction or expansion of a primary or accessory/appurtenant, nonresidential structure or facility
involving less than 4,000 square feet of gross floor area and not involving a change in zoning or a use
variance and consistent with local land use controls, but not radio communication or microwave
transmission facilities;
And, in accordance with Site Plan Review approval standards in the Unified Development Ordinance,Article
I 3.5, the Planning Board issued the following decision on June 27, 2024 passed 7-0 in favor: Marshall, Mayo,
McTygue, Morrison, King, Stellato, Ferrante:
C� Approve site plan set dated April 29, 2024 with the followin� revisions/conditions:
I. Remove existing middle driveway following construction of the new driveway to the north and
replace with grass/landscape.
2. Install a walkway between the two buildings.
3. Pedestrian accommodations shall be installed along the S. Broadway frontage upon approval by
DOT.
4. All exterior lighting shall be 3,OOOK
5. Landscaping shall be installed along the western side of the existing(restaurant) building to
include a hedgerow on the eastern side of the sidewalk to prevent deliveries from the shoulder
of the road.
6. All deliveries shall be conducted on-site.
7. A sidewalk shall be installed from the middle parking area to the existing (restaurant) building to
accommodate on-site deliveries.
The applicant is required to:
- Provide documentation of conformance with all required conditions of approval.

Note: This approval shall expire within eighteen (I 8) months if the applicant has not implemented the approval
per Article I 3.5 of the U DO.
