I apologize for the delay.
Regarding the use:
• The front half of the property Is in the UR-3 zoning district Rear half is in the UR-2 district. Single family and two family
use are allowed.
• The City property dassification in 1960 was "2 or 3 family".
• The City's Sanbom Insurance Map from 1954, updated through the mid'705 shows the property as a two family dwelling,
using addresses of 139A and 139B Elm St. The map indicates one unit on first floor, one unit second floor as opposed to
side by side.
• The Building Dept. file (f11165) has a UL Underwriters electrical inspection cerlifcate from 1974 for 3 services / 3 meters
• In the 1978 City-wide assessment survey, the property class was Indicated as 230 - 3 family residential
• City Director;,s corroborate a two family use prior to 1974, 3 family use after 1974
• An inspectio,, by the Housing Department, Building Department, and Fire Department in 1985 resulted in multiple housing
code violaticns. The property was being used as a 4 family at that time (1st floor front, 1st floor rear, 2nd floor left, 2nd
floor right) -.
• A stop work order was issued in 1991
• A stop work order was issued in 2013 for the rear 2nd story porch
• There are no permits or Certificates of Occupancy in the fle
Based on the information available to me, my determination is that the property is not a lawful 3 or 4 family dwelling. The uses
are not allowed in the zoning district and a thorough examination of the records does not show this to be a lawfully preexisting
nonconforming use. The property would be allowed to revert to a two family or single family use. A use variance from the ZBA
and Site Plan review from the Planning Board would be required in order to continue with a 3 or 4 family use.
The use of the property as a 3 or 4 family is a violation of City Zoning Ordinance Section 240-2.2(E)(1) - Prohibited Uses
The conversion of the property from a 2 family to 3 or 4 family is a violation of 118-4 (Permit Required) and 11B-7 (CO
required), along with a laundry list of Building Code violations.
My recommendation would be to add the zoning violation and building permit violations to the NOV in support for justification of
declaring the build.ing an unlawful structure, unsafe structure, and unfit for human occupancy. I support an order to vacate.
