HomeMy WebLinkAbout20240345 1 Kaydeross West SUP Modification NarrativeNARRATIVE APPLICATION FOR SPECIAL USE PERMIT AMENDMENT AND LOT CONSOLIDATION APPLICATION 1 Kaydeross Avenue West LLC The Applicant 1 Kaydeross Avenue West LLC (hereinafter “Applicant”) obtained approval for a special use permit for a marijuana dispensary at property located at 1 Kaydeross Avenue West, the current site of PJs Barbeque during the Planning Board meeting on October 12, 2023. Thereafter, the Applicant redesigned the site to modify the positioning of the proposed dispensary to be located along the Route 9 frontage, adjacent and north of the existing PJs Barbeque structure. This amendment seeks only to reposition the building. The responses to the Special Use Permit standards remain unchanged. In conjunction with the proposed amendment to the special use permit, the Applicant also seeks to consolidate the two lots that comprise the property which is the subject of this Amendment. By separate agreement with the present owners, the lot consolidation will not be effective, and the Applicant will not file a lot consolidation map in the Office of the Saratoga County Clerk until the closing of title occurs and the Applicant acquires title to the property. Subject to the foregoing, the Applicant is seeking approval of the lot consolidation now in conjunction with the site plan and amendment to special use permit. However, the Applicant will not seek execution of the lot consolidation map until site plan review has concluded and the property is acquired from Davis Restaurants LLC.
