Dear Ms. LaBreche:
Barton & Loguidice, D.P.C. (B&L) has completed a third review of the following reports and information
from Bohler for a project located at 3376 South Broadway proposed by Treehouse Microproduction
Brewery:
Stormwater Pollution Prevention Plan (SWPPP) dated December 4, 2023, revised March 22,
2024 as prepared by Bohler;
Preliminary Geotechnical Investigation dated January 9, 2024 as prepared by Whitestone;
Plan Set (19 Sheets) Last revised March 20, 2024 as prepared by Bohler and others;
Response letter dated January 23, 2024 from Bohler, signed by Steven Wilson, Project Manager;
Preliminary Engineering Report dated December 4, 2023 and revised March 21, 2024.
This review was conducted on behalf of the City of Saratoga Springs. The above referenced documents
and information were reviewed only with respect to our scope outlined in our task order/proposal.
General
1. Submit current correspondence with SCSD and review comments/responses with next
submission. Still pending.
2. Detail for proposed monument sign was not part of submission but references Architects plans
not received. Concern is for size of illumination and potential glare/impacts to motorists.
3. Label phase limits with respective acreage and include detailed construction sequencing
narrative/schedule on the plans and in the SWPPP. The SWPPP refers to the plans but no
labeling is noted. Response letter indicated this is being developed in concert with a contractor.
Include notes on erosion and sediment control plans that contractor and owner need to
coordinate with SWPPP monitoring professional to ensure previous areas disturbed in north lot
are stabilized before working on southern side of project and disturbed area never exceeds 5
acres in size.

Cost estimate
1. Response letter again indicated this is being prepared and will be included in next submission.
Preliminary Engineers Report
1. Confirm calculations for grease trap comply with NYSDEC sizing criteria. We recommend a larger
size unit to increase storage capacity and decrease frequency of pumped cleanouts from 3 months
to 6 months at least.
Traffic study comments
1. NYSDOT review indicates revisions necessary for the egress onto NYS Route 9. Provide final
approval from NYSDOT from subsequent review. Plans do not label type of service for entries (full
service, right only,…etc. Provide text of directional signs per Architectural plans and detail
referenced on C-301.Show pavement turn arrows on site plan.
2. Work in NYSDOT R.O.W. will require work permits, insurance and compliance with DOT
regulations.
Plans
C-401 –Grading and Drainage Plan
1. Label finished floor elevations of building and pavilions. Response letter indicated they were but
could not be found.
2. Show test pit locations and identifying numbers.
C-501-Utility Plan
1. Label 5’ of separation between water and gas services.
C-601-Soil erosion & Sediment control Plan
1. Provide a detail of temporary sediment trap. Notate removal of sediments before restoration.
2. Are temporary sediment traps or basins proposed during construction phase? Label all practices
including check dams, inlet protection devices and others. We recommend construction
sequencing notes on the plans that include de-compaction of soils and appropriate timing to
ensure porous pavement areas are protected from silt intrusion and sediment removals from
infiltration basins after vegetation is substantially covering the site and removal of sediment
trap and any other temporary practices.
C-902-Detail Sheet
1. Pervious pavement detail indicates 19-inches of reservoir stone, see comments above for a
deeper layer.
2. NYSDEC new details for pervious/porous pavement utilize two 3-inch layers of porous asphalt.
We recommend adoption of those thickness and pavement specifications.

1. Plans reflect a different grease trap model than report. What is cleanout frequency of Model
number GB-1500?
Stormwater Management
1. The geotechnical report recommends a safety factor of 2.5 and appears the 7.5-inches per hour is a
safety factor of 2 but is based on permeability of tests showing 15-inches per hour. If this are
predominantly over 15-inches per hour its likely fine. Deeping reservoir stone would be
recommended from 19-inches to 22-inches or more. Geotechnical report indicates over time the
likelihood of hydro-compaction of native soils beneath infiltration areas.
2. Check Modeling for porous pavement/ infiltration per modeling node PP-1 as it shows a peak
elevation over 30’ above the pavement for the 100 year storm. It obviously won’t get to that
elevation but an indication it comes to the surface during peak flows. Including a broad crested weir
at pavement level to mimic the parking lot elevation would lower the peak substantially. Deepening
reservoir stone could keep peak elevation below pavement.
City of Saratoga Spring DPW comments
Sheet C-501: For the sewer pipe, include within the callout description SDR-35 for PVC pipes or
whatever the description will be. Note the schedule 40 for the force main may not be accepted
by Saratoga County Sewer District.
Sheet C-401: Finished Floor Elevation is not showing up in the buildings on the plans. Possibly
frozen in CAD? Confirm they are visible on the plans.
Sheet L-200: Trees shown overtop storm lines and FES, consider shifting so roots don't grow into
piping or FES.
Recommendation: add note to plans to state "any work done within the ROW will need a
NYSDOT permit".
