NOTICE OF DECISION
In the matter of the application

Involving the premises with tax parcel #I 65.59-3-I 3, in the City of Saratoga Springs, on an application for Site
Plan Review for a new eating and drinking establishment including micro-production of alcohol and outdoor
dining and associated site work in the Gateway Commercial— Rural (GC-R) District.
In accordance with 6 NYCRR Part 6 I 7.4,the Planning Board classified the action as Type I, Coordinated SEQRA
Review, and as the designated Lead Agency for the review, determined that the project will not result in any
significant adverse environmental impacts,therefore, issued a Negative SEQRA Declaration on February 8, 2024
(passed 6-I- in favor: Marshall, Mayo, McTygue, Morrison, King, Stellato);
And, in accordance with Site Plan Review approval standards in the Unified Development Ordinance,Article
I 3.5, the Planning Board issued the following decision on April I I, 2024 passed 6-I in favor: Marshall, Pingel,
McTygue, Morrison, Stellato, Ferrante:
C� Approve site plan set with revision date 03/04/2024 with the followin�revisions and conditions:
I. A total of three speed bumps shall be installed along the ring road and employee parking area
for traffic calming through the property.
2. The fence along the rear property line shall be made of wood.
3. Final plans shall be provided to the satisfaction of the City's designated engineer and DPW.
The applicant is required to:
I. Provide documentation of conformance with all required conditions of approval.
2. Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to the
City. This must occur prior to final signature by the Planning Board Chair.
3. Submit two (2) paper copies and one (I) electronic copy of the final approved site plan set for
signature by the Planning Board Chair within ei�hteen (I 8) months of approval as per Article I 3.5
of the Unified Development Ordinance.
Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not
started actual construction as per Article I 3.5 of the U DO.
