NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION -#16.0I8
REGATTA VIEW AREA B PHASE III
UNION AVE./DYER SWITCH RD./REGATTA VIEW DR.
SARATOGA SPRINGS, NY 12866
Involving the premises with tax parcel #180.54-2-30, in the City of Saratoga Springs, on an application for site
plan for a 24-unit residential development in the Interlaken PUD.
In accordance with 6 NYCRR Part 617, the Planning Board classified this request as an Unlisted Action.
Issued a Negative SEQRA Declaration on April 4, 2019
And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter
240, article 7.2 "Site Plan Review",the Planning Board issues the following decision on July I I, 2019 (passed 7-0
in favor: Torpey, Totino, Bristol, Casey, Fabozzi,Jenks, Ryan):
Approve with the following conditions:
I. Applicant to provide and install adequate vegetative screening to 6 Regatta View Drive and I Flying
Dutchman Way properties to be reviewed and approved by the Chair.
2. Final plans shall be provided to the satisfaction of the City's designated engineer, DPW and DPS.
3. Species selection and planting specifications within the ROW of Dartmouth Way to be to the
satisfaction of the City arborist.
4. Final HOA language of the accessory use area to be to the satisfaction of the City attorney.
5. Pedestrian path location shall limit tree disturbance to provide maximum buffering to Rte. 9P.
6. Dartmouth Way to be built to city standards and accommodate on-street parking only on the north side
of the street next to the sidewalk.
7. Dartmouth Way to be maintained until the street is dedicated and accepted by the city.
8. All tree planting, curbing and lighting shall be in accordance with city standards.
The applicant is required to:
I. Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to the City per Article
7.2.15 of the City of Saratoga Springs Zoning Ordinance. This must occur prior to final signature by the
Planning Board Chair.
2. Submit one (I) mylar and two (2) paper copies of the final approved site plans for signature by the Planning
Board Chair within eighteen (18) months of approval as per Article 7.2.12 of the Zoning Ordinance.
Note: this approval shall expire within eighteen (18) months of the signature of final plans if the applicant has not
started actual construction as per Article 7.2.14 of the Zoning Ordinance.
