SARATOGA SPRINGS, NY I 2866 Involving the premises with tax parcel #I 79.29-3-26, in the City of Saratoga Springs, on an application for a renewable special use permit for outdoor entertainment in the Gateway Commercial— Urban (GC-U) District. In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as a Type II SEQRA Action: • (I 8) reuse of a residential or commercial structure, or of a structure containing mixed residential and commercial uses, where the residential or commercial use is a permitted use under the applicable zoning law or ordinance, including permitted by special use permit; Having properly noticed and conducted a public hearing on April I I, 2024 as required on the proposed use; And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the proposed use will not adversely affect surrounding properties and community character; And, in accordance with the approval standards set forth in the City's Unified Development Ordinance, article I 3.4 "Special Use",the Planning Board issues the following decision on April I I, 2024 (passed 7-0—in favor: Marshall, Pingel, Morrison, McTygue, King, Stellato, Ferrante): C� Issue a renewable special use permit for a period of 6-years for outdoor entertainment in�eneral conformance with the submitted sketch plan dated 4/5/2024 with the followin� revisions and conditions: Conditions: I. The outdoor entertainment with 44 seats shall be limited to six (6) days in addition to the days of the thoroughbred racing meet,with the total capacity of patrons governed by the NYS Fire Code. 2. The hours of operation for the outdoor entertainment shall be limited to between the hours of 4PM and I OPM Sunday through Thursday and between 4PM and I I PM Friday and Saturday. 3. The applicant shall continue to work with all adjacent residential properties to control and reduce any adverse impacts from this outdoor entertainment. 4. The applicant shall comply with all provisions of the City's Noise Ordinance. 5. The site shall be used in general conformance with the sketch plan attached hereto and dated 4/5/2024. 6. When outdoor entertainment is offered, the curb cut on Gridley St. at the Nelson Ave. intersection shall remain closed (barricaded) as shown on the sketch plan. 7. The applicant shall submit an application for site plan review no later than 6/I/2024. 8. The applicant shall comply/complete any site plan improvements no later than 5/3 I/2025. Page I of 2 9. This special use permit for outdoor entertainment shall expire in 6-years on May I 7, 2030, but upon application it may be renewed by the Planning Board.
