Re:SCPB Referral Review#24-33 -Area Variance-Stewart's Shop
A proposed redevelopment of the Mobil Gas station site and replace it with a Stewart's Shop
convenience store,tenant space, and a new car wash has created the need for three area variances.The
required front yard setback is 40 ft, where 8 ft is proposed for the Stewart's Shop building(32 ft of relief)
and 25 ft (15 ft of relief)for the gas canopy. Also,the relief for the rear yard setback for the canopy is
requested as 10 ft is the minimum required with 0 ft proposed (10 ft of relief).

Zoning: Tourist Related Business, Urban Residential-2 (Prior to UDO Update)
Received from the City of Saratoga Springs Zoning Board of Appeals on March 5, 2024.
Reviewed by the Saratoga County Planning Board on March 28, 2024.
Decision: No Significant County-wide or Intercommunity Impact.
Comments:A NYSDOT work permit and curb cut permit will be needed regarding the current access
improvements to US Route 9.
As a reminder, GML-239nn requires proposed special use permits, use variances, site plans and
subdivisions within 500 ft. of an adjacent municipality's shared boundary to notify the neighboring clerk
(Town of Wilton,Town of Greenfield), by mail or electronic transmission, of the pending project at least
10 days prior of any hearing.
