JInvolving the premises with Tax Parcel ID* 166.61-1-7, in the City of Saratoga Springs, on an application for
final plat review of a proposed two -lot subdivision within the Urban Residential - 3 (UR-3) District with the
Planning Board who met on May 25, 2023 and made the folkmwirig decision(s):
In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA short
Environmental Assessment Form Parts I and It. made a motiort to issue a Negative SEQRA Declaration on
` February 9, 2023;
\1 And. in accordance with the purpose and objectives set forth in the City's Unified Development Ordinance
Article 14 "Subdivision Approval". the Planning Board issued the following decision:
® Approve final subdivision plat (dated May 4, 2023) including the following conditions:
1. Removal of apartment from the existing garage.
2. Satisfaction of final plans by City Engineer's Office.
The applicant is required to complete the following prior to signing of the final plat by the Planning Board Chair.
• Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on- and
off -site improvements.
• Submit a fee in lieu of recreation of $2,000 for one new residential lot
• Submit one (1) mylar and two (2) paper copies of the final approved subdivision plat for signature by the
Plarhrting Board Chair.
• File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as
provided in Article 3, Section 32 of General City Law.
Approval of the final plat expires within one year after the resolution granting such approval unless all
requirements sated in such resolution have been certified and completed per Article 14 of the UDO.

1.) ALL WORK MUST CONFORM TO ALL FEDERAL, STATE AND CITY CODES,
SPECIFICATIONS, ORDINANCES, RULES AND REGULATIONS.
ELEVATIONS ESTABLISHED FROM INFORMATION SUPPLIED BY THE
CITY OF SARATOGA SPRINGS ENGINEER'S OFFICE.
3.) ALL REFUSE, DEBRIS AND MISCELLANEOUS ITEMS TO BE REMOVED
SHALL BE LEGALLY DISPOSED OF OFF -SITE BY THE CONTRACTOR
TO A LOCATION APPROVED BY THE CITY ENGINEER.
4.) THE CONTRACTOR MUST SET UP A PRE -CONSTRUCTION MEETING
WITH THE CITY ENGINEER PRIOR TO ANY CONSTRUCTION.
CONSTRUCTION INSPECTIONS BY THE CITY ENGINEER OR A
DESIGNATED REPRESENTATIVE ARE REQUIRED. THE COST OF THE
CONSTRUCTION INSPECTION IS THE RESPONSIBILITY OF THE
APPLICANT/DEVELOPER. AN ESCROW ACCOUNT TO COVER
THE COST OF THE INSPECTIONS MUST BE ESTABLISHED PRIOR
TO ANY CONSTRUCTION.
5.) THE CONTRACTOR MUST OBTAIN A BLASTING PERMIT FROM THE
BUILDING INSPECTOR IF ANY BLASTING IS REQUIRED FOR THE
PROJECT.
6.) THE CONTRACTOR MUST OBTAIN A STREET OPENING PERMIT ISSUED
BY THE DEPARTMENT OF PUBLIC WORKS FOR ANY WORK IN THE
STREET OR RIGHT OF WAY OF ANY CITY STREET, ROAD OR ALLEY.
7.) ALL POINTS OF CONSTRUCTION INGRESS AND EGRESS SHALL BE
MAINTAINED TO PREVENT TRACKING OR FLOWING OF SEDIMENT OR
DEBRIS ONTO A PUBLIC ROAD.
8.) NO CERTIFICATE OF OCCUPANCY WILL BE ISSUED UNTIL ALL SITE
WORK HAS BEEN COMPLETED IN ACCORDANCE WITH THE APPROVED
PLANS AND AN AS -BUILT DRAWING HAS BEEN PREPARED IN

As per the submitted plans or lesser dimensions, be APPROVED for the following reasons:
1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant.
The applicant considered other alternatives. including altering the lot lines, but such alterations would
have compromised the size of both lots I and 2, making them undesirable to the applicant and would
compromise the size of the existing lot I and potentially result in more relief needs.
2. The South side of Caroline Street currently has similar lot sizes, but once this lot is subdivided it will be
become more consistent with homes on the north side of Caroline Street. The applicants note that the
proposed new boundary and lot configuration are consistent with the UDO and will provide sufficient
space for a zoning -compliant new home construction on Lot 2. The current garage is exiting and the south
west roof is proposed to be modified to remove the roof comer which infringes over the property line. if
the garage is demolished the permitted zero -foot setback would no longer apply.
The applicants provided the Board with information on comparable lots in the neighborhood so that Lot 2
would be consistent with neighborhood context. While the Board is generally not in favor ofereating non-
compliant sized new lots, the shortfall in total lot size in this case is not significant.

3. Therequested variances arc not considered substantial besides the garage; however, since it is existing,
this is not necessarily fatal to the application.
4. The Applicant has demonstrated that granting this variance will not have an adverse physical or
environmental elTect on the neighborhood.
5. The request for relief is a sel&created hardship. However, self -creation is not necessarily fatal to the
application.
Condition: if the garage is removed the permitted zero -foot setback- will no longer apply.
Notes: The City Planning Board issued a favorable advisory and concluded a negative declaration for the SFQR
on February 9t° 2023.
