I 37 MAPLE AVENUE SARATOGA SPRINGS, NY I 2866 Involving the premises with tax parcel #I 65.44-2-24, in the City of Saratoga Springs, on an application for a permanent special use permit for a marijuana dispensary in the Neighborhood Center(T-5) District. In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as a Type II SEQRA Action: • (I 8) reuse of a residential or commercial structure, or of a structure containing mixed residential and commercial uses, where the residential or commercial use is a permitted use under the applicable zoning law or ordinance, including permitted by special use permit; Having properly noticed and conducted a public hearing on March 14, 2024 as required on the proposed use; And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the proposed use will not adversely affect surrounding properties and community character; And, in accordance with the approval standards set forth in the City's Unified Development Ordinance, article I 3.4 "Special Use",the Planning Board issues the following decision on March I 4, 2024 (passed 5-2—in favor: Marshall, Mayo, Morrison, King, Stellato): C� Issue a special use permit for a marijuana dispensary(approximately I,850 sq. ft.)within an existin�buildin�� in�eneral conformance with the submitted mock-up aerial photo with the followin� revisions and conditions: Conditions: I. Requested waiver of site plan review not granted. 2. Reuse of existing freestanding sign structure not approved. DRB review and approval of the sign required prior to site plan review. 3. Trash and recycling shall be kept in enclosed containers to be located on the west side of the building, adjacent to Route 50. If trash and recycling shall exceed two large residential type containers then an enclosure shall be constructed subject to site plan review. 4. The applicant shall submit a narrative and plan of the point of sale system. 5. Hours of operation are as follows: Sun. 9am — 6pm, Mon. — Thurs. I Oam — 9pm, Fri. & Sat. 9am — IOpm.
