It then goes on to state that a licensed premise for the dispensary of cannabis cannot be near a community facility. Its unclear whether this guidance has since been superseded, but clearly was at some point the guidance from the NYS Cannabis Control Board. Relevant snips below: Pg. 18 Below is also what we have posted to the community boards and attached images… **New Marijuana Dispensary in Gateway / View Corridor to Historic Downtown, Residential Neighborhoods, High Rock Park and Addiction Recovery Center** Friends and neighbors in Saratoga Springs! My family and I are writing to alert neighbors to a concerning letter we received in the mail this past week from the Planning Board. The City’s fairly broad reaching re-zoning in 2022 now allows marijuana retailers to be immediately adjacent to, and intertwined with, residential neighborhoods, parks and the historic district in downtown Saratoga Springs. We were alerted to this by one seeking a special use permit to open 200 feet from our home at 137 Maple Avenue, which also happens to be immediately next to other residential homes, historic High Rock Park and Old Bryan Inn and surprisingly within feet of an Addiction Recovery Clinic. This also is on the route we, and many of our neighbors, take to walk our children to the schools downtown and is within feet of an entrance to High Rock Park that many families use to access the park for biking, sledding, picnicking and other activities. While our family certainly supports small business and entrepreneurs investing in our City and supports intelligent growth and development, this is the wrong location for a marijuana shop as it will degrade the family focused character of the neighborhood, cheapen the historical importance of these iconic Saratoga destinations and with signage on Route 50 (see image 3/14/24, 10:02 AM Zimbra https://m.saratoga-springs.org/h/printmessage?id=27217&tz=America/New_York 4/9 below), will also be one of the first and last impressions visitors have as they arrive and exit our historic downtown area. We strongly urge all neighbors to come out this Thursday, March 14th at 6:00 PM to City Hall to express their concerns about not only this project but the overall re-zoning approach for these retailers as it was broad sweeping and could result in such dispensaries being placed throughout other residential neighborhoods, with the only local regulatory limitation being that they not be placed within 1,000 feet of each other.
