NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION
#20230919

3376 SOUTH BROADWAY
SARATOGA SPRINGS, NY I 2866
Involving the premises with tax parcel #I 65.59-3-I 3, in the City of Saratoga Springs, on an application for a
permanent Special Use Permit for outdoor dining associated with a new eating and drinking establishment with
micro-production of alcohol in the Gateway Commercial— Rural (GC-R) District.
In accordance with 6 NYCRR Part 6 I 7.4,the Planning Board classified the action as Type I, Coordinated SEQRA
Review, and as the designated Lead Agency for the review, determined that the project will not result in any
significant adverse environmental impacts,therefore, issued a Negative SEQRA Declaration on February 8, 2024
(passed 6-I- in favor: Marshall, Mayo, McTygue, Morrison, King, Stellato);
Having properly noticed and conducted a public hearing on November 30, 2023 as required on the proposed use
and closed the public hearing on February 8, 2024;
And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the
proposed use(s)will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City's Unified Development Ordinance,Article
I 3.4 "Special Use",the Planning Board issues the following decision on February 8, 2024 (passed 7-0—in favor:
Marshall, Pingel, Mayo, McTygue, Morrison, King, Stellato):
C� Issue a permanent Special Use Permit for outdoor dinin�as described in the project narrative and as shown on
revised site plan set with revision date February 2, 2024 and subject to the followin�conditions:
Conditions:
I. The number of outdoor seats shall not exceed 267 and shall not exceed 50%of the approved number
of indoor seats.
2. The use of any device for the amplification of sound shall not exceed an instantaneous sound-pressure
level of 85 decibels dB(A).
3. The hours of operation for the facility are as follows: 9am-I I pm Sun.—Thurs.,and 9am-I 2am Fri. and
Sat.
4. All live music shall end at I I pm every day.
