NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION
#20230942

Involving the premises with tax parcel # I 66.30-2- I 2, in the City of Saratoga Springs, on an application for a
Special Use Permit modification to increase the number of residential units for a previously approved mixed-use
development in the Neighborhood Center (T-5) District.
In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as a Type II SEQRA Action:
(9) construction or expansion of a primary or accessory/appurtenant, nonresidential structure or facility involving
less than 4,000 square feet of gross floor area and not involving a change in zoning or a use variance and
consistent with local land use controls, but not radio communication or microwave transmission facilities
Having properly noticed and conducted a public hearing on January 25, 2024 as required on the proposed use;
And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the
proposed use(s) will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City's Unified Development Ordinance, Article
I 3.4 "Special Use", the Planning Board issues the following decision on January 25, 2024 (passed 7-0 — in favor:
Marshall, Pingel, Mayo, McTygue, Morrison, King, Stellato):
C� Issue a Special Use Permit modification to increase the permitted residential units from 55 units to 56 units bX
convertin� an existin� interior space (3rd-floor exercise room) into a studio apartment.
Note: this approval shall expire within I 8 months of the date of approval if the building permit required for the
use has not been obtained.
