NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION

Involving the premises with tax parcel #I 79.29-2-I 7, in the City of Saratoga Springs, on applications for a Special
Use Permit Modification and Site Plan Review Modification to expand an existing horse barn in the Institutional
Horse Track Related (INST-HTR) District.
In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as a Type II SEQRA Action:
(9) construction or expansion of a primary or accessory/appurtenant, nonresidential structure or facility involving
less than 4,000 square feet of gross floor area and not involving a change in zoning or a use variance and
consistent with local land use controls, but not radio communication or microwave transmission facilities
Having properly noticed and conducted a public hearing on February 8, 2024 as required on the proposed use;
And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the
proposed use(s)will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City's Unified Development Ordinance,Article
I 3.4 "Special Use",the Planning Board issues the following decision on February 8, 2024 (passed 7-0—in favor:
Marshall, Pingel, Mayo, McTygue, Morrison, King, Stellato):
C� Issue a Special Use Permit modification to expand an existin�horse barn—addition of 8 new horse stalls (I,I 84
sq. ft.),with a total covera�e of 2,294 sq. ft.
And, in accordance with Site Plan Review approval standards in the Unified Development Ordinance,Article
I 3.5 "Site Plan Review", the Planning Board issues the following decision on February 8, 2024 (passed 7-0 in
favor: Marshall, Pingel, Mayo, McTygue, Morrison, King, Stellato):
C�Approve Site Plan modification (set dated December I 2, 2023) as presented.
The applicant is required to:
Submit two (2) paper copies and one (I) electronic copy of the final approved site plan set for signature by the
Planning Board Chair within ei�hteen (I 8) months of approval as per Article I 3.5 of the Unified Development
Ordinance.

Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not
started actual construction as per Article I 3.5 of the U DO.
