NOTICE OF DECISION
In the matter of the application - #20230267

Involving the premises with tax parcel no. I 65.5 I-I-37 & 38 in the City of Saratoga Springs, on an
application for site plan review for a proposed mixed-use project including non-residential space and 23
residential units and associated site worlc in the Neighborhood Center (T-5) District.
In accordance with 6 NYCRR Part 6 I 7, the Planning Board classified the action as Unlisted and issued a
Negative SEQRA Declaration on January 25, 2024 passed 7-0 in favor: Marshall, Pingel, Mayo,
McTygue, Morrison, King, Stellato;
And, in accordance with Site Plan Review approval standards in the Unified Development Ordinance,
Article I 3.5, the Planning Board issued the following decision on January 25, 2024 passed 7-0 in favor:
Marshall, Pingel, Mayo, McTygue, Morrison, King, Stellato:
C�1 Approve site plan set dated October I 3, 2023 with the followin� revisions and conditions:
I. A 6-foot wide sidewallc shall be installed along the Church St. frontage.
2. The on-site civic space shall be removed and replaced with off-site civic space to be
located at Franlclin Square Parlc and surrounding area.
3. The northeast-corner of the building (former civic space area) shall be enclosed and the
modified architectural design shall be approved by the Design Review Board.
4. The applicant shall submit a master plan for off-site civic space at Franlclin Square Parlc
and surrounding area to the satisfaction of DPW and Planning staff and return before
the Planning Board for final review and approval within 4 months of SPR approval.
5. The subsequent agreed-upon off-site civic space improvements shall be installed to the
satisfaction of DPW and Planning staff prior to issuance of a Certificate of Occupancy
for the building.
6. Final plans shall be provided to the satisfaction of the City's designated engineer and
D PW.
7. The applicant shall provide a management plan for the community space.
8. The applicant shall provide third-party verification of high performance construction.

9. The applicant shall provide the fee in lieu of dedication of recreational lands for each of
the residential units (totaling$46,000).
The applicant is required to:
I. Provide documentation of conformance with all required conditions of approval.
2. Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to
the City. This must occur prior to final signature by the Planning Board Chair.
3. Submit two (2) paper copies and one (I) electronic copy of the final approved site plan
set for signature by the Planning Board Chair within ei�hteen (I 8) months of approval as
per Article I 3.5 of the Unified Development Ordinance.
Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant
has not started actual construction as per Article I 3.5 of the U DO.
