Based on the submitted evidence that the application for an extension of a granted area variance does not
differ from the original application and approval, and that there have been no changes in the condition of
the property or neighborhood warranting otherwise the previous application number being #202200087,
the Board moves that the application of B&D Property, LLC for the property located at 126 West Avenue
in the City of Saratoga Springs, and identified as tax parcel 165.72-1-22.1 that was granted on July 25th
2022 to permit the construction of a new mixed-use development project in the T-4 district be approved
and that the variance approval be extended for 18 months from the date that such resolution expired,
January 25th, 2024 with the new expiration date to be July 25th, 2025. The variance shall expire on July
25th, 2025 unless the necessary building permit has been issued and actual construction begun as per the
Zoning Ordinance or otherwise further extended.
It is so moved, dated February 12th,2024.

This variance shall expire 18 months following the filing date of such decision unless the

members of the Board being present.
