RE: Advisory Opinion to the City Council — Zoning Map Amendment on West Side of Beekman Street
Dear Mayor and Commissioners,
Pursuant to City Council action on November 8, 2023 requesting an advisory opinion from the Planning
Board, this board reviewed the proposed map amendment for three parcels on Beekman St. between
Grand Ave. and Washington St. ( I 03 Beekman St., I 43 Grand Ave., I 38 Washington St.) from Urban
Residential — 3 (UR-3) to Arts & Culture (AC) District.
Per the UDO, the Planning Board recommendation and the City Council decision on any Zoning Text
Amendment must consider the following standards ( I 3. I 5 E.2):
a. The consistency of the proposed amendment with the Comprehensive Plan and whether the
proposed amendment provides a more workable way to achieve the intent and purposes of this
Ordinance and the Comprehensive Plan.
b. The consistency of the proposed amendment with the intent and general regulations of this
Ordinance.
c. The extent to which the proposed amendment promotes the public health, safety, and welfare of
the City.
d. Whether the proposed amendment corrects an error or omission, adds clarification to existing
requirements, or reflects a change in policy.
e. The extent to which the proposed amendment creates nonconformities.
The Planning Board considered the proposed map amendment at its January I I , 2024 meeting and issued
a favorable advisory opinion by 5-0 vote.
