Dear Ms. LaBreche:
Barton & Loguidice, D.P.C. (B&L) has completed a first review of the following reports and information
from Bohler for a project located at 3376 South Broadway proposed by Treehouse Microproduction
Brewery:
Traffic Impact Study dated November, 2023 as prepared by GTS Consulting;
This review was conducted on behalf of the City of Saratoga Springs. The above referenced documents
and information were reviewed only with respect to our scope outlined in our task order/proposal.
Traffic Study Comments
1. The traffic assessments were completed in accordance with industry accepted practices
and methodology.
2. We take no exception to the Travel Speeds or Traffic Gap analyses completed.
3. There are no concerns with the sight distance analysis as there is adequate sight
distance. Although not specifically stated in section 2.3, the available sight distances
can accommodate passenger cars in addition to single-unit and combination delivery
trucks (2 lanes crossed), if necessary.
4. The evening (Friday) and Saturday peak hours of 4:30 to 5:30 PM and 12:15 to 1:15 PM,
respectively, are consistent with the mainline and turning movement data collected for
the Traffic Impact Study (TIS).
5. Is the projected trip generation and distribution for the 215 approved apartments on
Crescent Avenue consistent with the TIS that was developed for that site’s planning
board approval? Do any of the trips travel east along Crescent Avenue
(entering/exiting) from the proposed site, or do all trips travel west toward US Route 9
as shown on Figure 4 of Appendix D? If there are inconsistencies with the approved
apartment TIS, please include updates on Figures 4 and 5.

6. We agree with the pass-by trip rate of 25%. Although, the pass-by trip volumes in the
Trip Generation Summary table on Page 8 should be checked and re -calculated. The
pass-by trips should only be 25% of the On-Premises Beverage & Pizza generated traffic
volumes. The Off-Premises Beverage Sales should not be included in the pass-by trip
credit since those are described as pre-orders and would not be trips that are already
driving by the site.
7. There is a typographical error in Figure 1 in Appendix D, for the intersection of US Route
9 and Crescent Avenue. The US Route 9 southbound through (thru) movement for
Friday Evening should be 753, as shown in Appendix C Traffic Count Data, not 735.
Please carry this revision through to the southbound “Passing by the Site” vehicle total
of 811 on Figure 1, on Figures 2 and 3 for the same movements, and additionally in
Section 3.1 of the Traffic Impact Study.
8. On Figure 1 of Appendix D, please confirm the total number of northbound “Passing by
the Site” vehicles. It appears that the northbound directional total is greater than the
combined turning count data from the US Route 9 and E. West Road turning count. If
any revisions are required, please carry them through to Figures 2 and 3 of Appendix D.
9. Does the traffic growth rate consider any recommendations from the Capital Region
Transportation Council (CRTC) and/or is it consistent with growth rate(s) utilized on
other Traffic Impact Studies in close proximities to this proposed development?
10. The proposed development is within the jurisdictional boundary of the City of Saratoga
Springs. Please confirm if the proposed development will require coordination with the
New York State Department of Transportation (NYSDOT) and completion of a
Commercial Highway Work Permit Application and a Highway Work Permit Application
for Non-Utility Work prior to construction.
11. No ITE Trip Generation data sources exist for Off-Premises Beverage Sales. The TIS
utilized similar data from three (3) of the same facility types in Massachusetts and
averaged the Friday and Saturday average sales trips per hour. In the absence of other
available data, we take no exception to this method of estimating trip generation.
However, for comparison purposes, what are the services and square footages provided
at the sites in Massachusetts?
12. ITE Trip Generation data is limited (Small Sample Size) for LUC-975 during Saturday peak
hours. In the absence of better ITE data, please update the peak hour trip generation
data with the similar Massachusetts facilities noted in the report? Another potential
option could compare traffic projections and/or actual trips at the recently constructed
Druthers Brewing facility in Clifton Park, New York if that data is available.
13. We take no exception to the Crash Analyses completed. The interse ction and segment
crash rates are equivalent to or below the Statewide Average for similar facilities.
