Poitras, of 35 Newton Ave., Saratoga Springs, New York 12866, party of the first part, and Colin Klepetar & Megan Mumford, tenants by the entirety of 58 Newton Ave, Saratoga Springs , New York 12866, parties of the second part, WITNESSETH, that the party of the first part, in consideration of one dollar and other good and valuable consideration, lawful money of the United States, paid by the parties of the second part, does hereby grant and release unto the parties of the second part, Colin Kleptar & Megan Mumford and assigns forever, all that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situated lying and being in the City of Saratoga Springs, County of Saratoga, State of New York more fully described in "Schedule A" attached hereto; Being and hereby intending to convey the same premises as conveyed to Joseph E. Poitras and Hazel B. Poitras, husband and wife, by Deed dated June 16, 1997, and recorded in the Saratoga County Clerk's Office on June 17, 1997, in Liber/Reel 1464 of Deeds, at page 28; The said Joseph E. Poitras having died a resident of the County of Saratoga on the 2nd day of June 2020 leaving as the surviving tenant, Hazel B. Poitras; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, their heirs and assigns forever. And said party of the first part covenants as follows: FIRST. That said party of the first part is seized of said premises in fee simple, and has good right to convey the same; SECOND. That the party of the second part shall quietly enjoy the said premises; THIRD. That the said premises are free from encumbrances; FOURTH. That the party of the first part will execute or procure any further necessary assurance of the title to said premises; FIFTH. That said party of the first part will forever warrant the title to said premises. AND the party of the first part/grantor, in compliance with Section 13 of the Lien Law, covenants that the party of the first part/grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word party or grantor shall be construed as if it read parties or grantors whenever the sense of this document so requires.
