Crescent Ave. and Jefferson St. Saratoga Springs, NY I 2866 Involving the premises with tax parcel no. I 79.-5-8 in the City of Saratoga Springs, on an application for site plan review for a proposed multi-family residential project including 2 I 2 affordable housing units and associated site work in the Urban Residential—4 (UR-4) District. In accordance with 6 NYCRR Part 6 I 7, the City Council classified the action as Type I and issued a Negative SEQRA Declaration on December 20, 2022; And, in accordance with Site Plan Review approval standards in the Unified Development Ordinance,Article I 3.5, the Planning Board issued the following decision on December 14, 2023 passed 5-0 in favor: Torpey, Pingel, Marshall, McTygue, Morrison: C� Approve site plan set with revision date Au�ust 3 I, 2023 with the followin�conditions: I. The applicant shall provide a current validation of wetland delineation from DEC and ACOE (most recent wetland delineations from 20 I 8). 2. The applicant shall commit I 0%of the total residential units (2 I units) at or below 30%annual median income (AMI) for a period of no less than 30-years. 3. The Board shall accept fee in lieu payment for installation of sidewalk along the Crescent Ave. frontage of I,355 linear feet (LF) (approx. $I 0 I,625). The Board recommends that the fee be dedicated to design and construction of the Jefferson St. sidewalk and catch basin. 4. The Board shall accept fee in lieu payment for installation of sidewalk along Jefferson St. frontage of approx. 650 LF (approx. $60,000 includes catch basin required per DPW). The Board recommends that the fee be dedicated to future design and/or construction of the Crescent Ave. Connector of the Saratoga Greenbelt Trail to be located on the south side of Crescent Ave. 5. The Board shall accept the offer of approx. I 6.4-acres of Class B recreational land to be held in a conservation easement enforceable by the City. 6. The Board recommends that the City Council accept applicants offering of a deed for approx. 3.5- acres of Class A recreational land. The deed shall include a sanitary sewer easement to the applicant. 7. The Board finds that the total I 9.9-acres of combined Class A and Class B recreational lands satisfies the recreation land requirement in I 5.8 of the UDO;therefore, no fee in lieu of land is required. 8. The conservation easement language for the I 6.4-acres of Class B recreational land shall be to the satisfaction of City legal counsel and the City Council. 9. The applicant shall provide signed Universal Access Agreement with CDTA and confirmation that existing route 45 I will be extended to provide bus service to the project. Page I of 2 I 0. The applicant shall provide a revised site plan set to the satisfaction of City Engineers' Office and the City's Designated Engineer. I I. The applicant shall provide the sidewalk in-lieu payment prior to issuance of a building permit (instead of prior to signing of final plans by the Chair)to provide additional time for the applicant to submit for funding of the project to NYS HCR. The applicant is required to: I. Provide documentation of conformance with all required conditions of approval. 2. Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to the City. This must occur prior to final signature by the Planning Board Chair. 3. Submit two (2) paper copies and one (I) electronic copy of the final approved site plan set for signature by the Planning Board Chair within ei�hteen (I 8) months of approval as per Article I 3.5 of the Unified Development Ordinance. Note: this approval shall expire within eighteen (I 8) months of the signature of final plans if the applicant has not started actual construction as per Article I 3.5 of the U DO.
