NOTICE OF DECISION
IN THE MATTER OF THE FINAL SUBDIVISION APPLICATION #20220889 OF
KIRBY ROAD SUBDIVISION
5 KIRBY ROAD
SARATOGA SPRINGS, NY 12866
Involving the premises with Tax Parcel ID# 165.13-2-80, in the City of Saratoga Springs, on an application
for final plat review of a proposed two -lot subdivision within the Urban Residential - I (UR-1) District with
the Planning Board who met on December 8, 2022 and made the following decision(s):
I n accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA short
Environmental Assessment Form Parts I and II, made a motion to issue a Negative SEQRA Declaration on May 5,
2022;
And, in accordance with requirements set forth in the City's Subdivision Regulations, the Planning Board
issued the following decision:
0 Approve the final subdivision plat with the following conditions:
• Water and sanitary sewer connections to lot 2 shall be relocated to avoid removal of trees within the
City ROW along Glenwood Rd.
• Any tree removal in the ROW for placement of driveway and installation of utilities shall be approved by
DPW.
• The Planning Board shall accept a payment in lieu of installation of a sidewalk along the Glenwood Rd.
frontage of 202 LF - cost to be determined by DPW.
• The payment shall be used to install a 5 ft. wide concrete sidewalk in the City ROW along the frontage
of 54 Kirby Rd. (165.13-2-81.1) of approximately 215 LF.
• Any new house on lot 2 shall have a minimum 18 ft. setback from the property line to the east (5
Glenwood DO165.13-2-64)
• Final plans shall be to the satisfaction of DPW.
• The Planning Board shall accept payment of the fee in lieu of dedication of recreation lands for one new
lot.
The applicant is required to complete the following as perthe Cityof Saratoga Springs Subdivision Regulations:
• Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on- and
off -site improvements.
• Submit a fee in lieu of recreation of $2,000 for each new residential lot per Appendix A of the
Subdivision Regulations.
• Submit two (2) mylar and two (2) paper copies of the final approved subdivision plat for signature by
the Planning Board Chair.
• File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as
provided in Article 3, Section 32 of General City Law.
Approval of the final plat expires within one year after the resolution granting such approval unless all
requirements stated in such resolution have been certified and completed 14 of the UDO.

from the determination of the Building Inspector involving a parcel at 52 Kirby Road in the City of
Saratoga Springs, New York being tax parcel number 165.13-2-37, in an UR-i district on the Assessment
Map of said City.
The applicant having applied for an area variance under the Zoning Ordinance of said City to permit a
subdivision to create two parcels, in which there is currently existing home on the property sited on "Lot
I" on the corner of Kirby Road and Glenwood Avenue and with a new "Lot 2" on Glenwood Avenue,
and public notice having been duly given of a hearing on said application held April 4 and 25, June 6
and 27, 2022.
In consideration of the balance between benefit to the applicant with detriment to the health, safety and
welfare of the community, I move that the following area variances for the following amount of relief:

As per the submitted plans or lesser dimensions,. be approved for the following reasons:
I. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the
applicant. The applicant has a deep lot and would like to divide the lot to build a single family
home on lot #2. The Board notes that the proposed lots meet district width requirements. The
house on Lot 41 which is existing meets all side, front and rear setback requirements, although the
garage does not but is pre-existing, non -conforming. The applicant presented a potential plan for
a house on lot 92 that would also meet all side, front and rear setback requirements.
2. The applicant has demonstrated that granting these variances will not create an undesirable change
in neighborhood character or detriment to nearby properties. The lot is located on Kirby Road,
however, the subdivision would create a new lot on Glenwood Avenue. The lot would be
consistent with existing lots and homes located on Glenwood Avenue. The applicant further
provided the Board with inl'onnation on comparable lots in the neighborhood and identified three
lots that arc in the same rank of square footage as the lots proposed. The Board notes that the
neighborhood does not has opportunities for further division of lots with the exception of the lot
immediately next to the applicants lot, but feels this will not create a precedent.
3. The Board notes that the variance is not substantial.
4. This variance will not has a significant adverse physical or environmental effect on the
neighborhood or district. All district penneability will be met.
5. These areas of relief are self-created insofar as the applicant's desire to subdivide this parcel, but
that by itself is not fatal to the application.
