NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION

CELLCO PARTNERSHIP/VERIZON WIRELESS
233 LAKE AVENUE
SARATOGA SPRINGS, NY I 2866
Involving the premises with tax parcel # I 66.-4-22. I , in the City of Saratoga Springs, on an application for a
permanent special use permit for a wireless telecommunications facility on an existing structure in the Urban
Residential — I District.
The Planning Board issued a Negative SEQRA Declaration on November 9, 2023;
Having properly noticed and conducted a public hearing on September 7, continued the public hearing until it was
closed on November 9, 2023 as required on the proposed use;
And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the
proposed use will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City's Unified Development Ordinance, article
I 3.4 "Special Use", the Planning Board issues the following decision on November 9, 2023 (passed 5-0 — in
favor: Torpey, Pingel, Mayo, Marshall, McTygue):
C� Issue a permanent special use permit for a telecommunications facility on an existin� structure with the followin�
conditions:
Conditions:
I . DRB consider through Architectural Review jurisdiction the addition of low profile screening on the
edge of the roof to the North.
2. Issue a waiver from site plan review.
Note: this approval shall expire I 8 months from the issuance date unless all conditions have been complied
with and a building permit issued.
