This being an application for an area variance under the Unified Development Ordinance of said City to permit the rebrandin of an existing movie theatre in the Urban Core UC/T-6 District.,and public notice having been duly given of a hearing on said application held from September 25th to December 11,2023. In consideration of the balance between benefit to the applicant with detriment to the health, safety, and welfare of the community, I move that the following area variances for the following amounts of relief: TYPE OF REQUIREMENT DISTRICT DIMENSIONAL PROPOSED RELIEF REQUESTED REQUIREMENT SIGN C 18" 24" 6"OR 33.3%RELIEF MAX LETTER HEIGHT(INCHES): "HALO LIT"LETTERING SIGN D 18" 3 6" 18"OR 100%RELIEF MAX LETTER HEIGHT(INCHES): CHANNEL LIT LETTERING SIGN F 18" 26" 8"OR 44.4%RELIEF MAX LETTER HEIGHT(INCHES): CHANNEL LIT LETTERING SIGN G 18" 24" 6"OR 33.3%RELIEF MAX LETTER HEIGHT(INCHES): "HALO LIT"LETTERING As per the submitted plans or lesser dimensions, be approved for the following reasons: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. Per the applicant,they would like to modify a previously approved sign package due the Page 1 of 2 rebranding,this will result in a reduction in the number of signs and in some cases sign square footage. The Board notes the previously granted variance dated April 08, 2013 provides significant relief that is not required by the current applicant. 2. The applicant has demonstrated that granting these variances will not create an undesirable change in neighborhood character or detriment to nearby properties. The Board requested and received DRB Advisory dated October 18,2023,the applicant has modified their request based on the advisory received from the DRB and as such the Board noted the current variance request is appropriate. 3. The Board notes that the requested variances are substantial,but this is mitigated by the factors described above. 4. This variance will not have a significant adverse physical or environmental effect on the neighborhood or district. 5. The alleged difficulty is self-created insofar as it is motivated by the applicant's desire to rebrand a movie theatre but this is not necessarily fatal to the application. Note: DRB advisory received October 18, 2023. DRB approval is required. Condition: This Variance is expressly conditioned on the applicants request and consent that the variance previously granted on April 08, 2023 shall be deemed expired,null and void upon request for a sign permit in furtherance of the relief granted in this approval.
