IN THE MATTER OF THE APPEAL OF

From the determination of the Building Inspector involving the premises at 17 Alger Street in the City of
Saratoga Springs, New York being tax parcel number 166.43-2-37 on the Assessment Map of said City.
The applicant having applied for an area variance to permit an addition to a single-family home in the
Urban Residential 3 (UR-3) District and public notice having been duly given of a hearing on said
application held on December I Vh, 2023.
In consideration of the balance between benefit to the applicant with detriment to the health, safety and
welfare of the community, I move that the following area variances for the following amount of relief:

as per the submitted plans modified by the applicant during the meeting on Monday December 11, 2023
or lesser dimensions, be APPROVED for the following reasons:
1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the
applicant. The applicant wants to construct an addition to their current home. The Board notes the
applicant has considered other alternatives. The applicant also noted that no property is available
for purchase.
2. The applicant has demonstrated that granting this variance will not create an undesirable change in
neighborhood character or detriment to nearby properties. The addition is consistent with other
homes in the neighborhood and does not alter the current character of the street. The applicant
provided district comparables to demonstrate a consistency in neighborhood context. The board
notes that the requested rear variance is substantial, but is mitigated by neighborhood context,
among other factors noted above.
3. This variance will not have a significant adverse physical or environmental effect on the
neighborhood or district. Standard district permeability requirements will be met.
4. The alleged difficulty is considered self-created insofar as the applicant desires to construct the
addition; however, this is not necessarily fatal to the application.

This variance shall expire 18 months following the filing date of such decision unless the
necessary building permit has been issued and actual construction begun as per the Unified

Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, five
members of the Board being present.
