This being an application for an area variance under the Zoning Ordinance of said City to permit the removal of an existing wraparound front porch and its replacement with two smaller covered entries to the front door and mudroom entrances, as well as the addition of"eyebrow" covers over the existing garage doors, and public notice having been duly given of a hearing on said application held on December 11, 2023. In consideration of the balance between benefit to the applicant with detriment to the health, safety, and welfare of the community, I move that the following area variances for the following amounts of relief: TYPE OF REQUIREMENT DISTRICT PROPOSED RELIEF REQUESTED DIMENSIONAL REQUIREMENT FRONT SETBACK TO NEW PORCH 10, 4.9' 5.1' OR 5 1%RELIEF INTERIOR SIDE SETBACK TO NEW PORCH 5' 3' 2' OR 40%RELIEF SIDE SETBACK TO ACCESSORY STRUCTURE 5' 2.3' 2.7' OR 54%RELIEF As per the submitted plans or lesser dimensions, be approved for the following reasons: l. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. Per the applicant,they would like to replace an existing single large wraparound porch area that currently provides access to both the main front entrance and the mudroom entrance with two smaller covered porch areas, as well as adding "eyebrow" covers extending over their existing garage doors. The Board notes that the existing structures on the property already sit within the required setbacks, and that these changes have been proposed in such a way that they will not extend the footprint of either of the currently existing structures on the property. Page 1 of 2 2. The applicant has demonstrated that granting these variances will not create an undesirable change in neighborhood character or detriment to nearby properties. The applicant notes that the total porch coverage area will be substantially reduced, and that the existing roof overhang front setback will be slightly increased. The Board notes that the proposed new"eyebrow" covers are minor additions that will improve the appearance of an existing accessory structure, and that the property will appear closely in line with nearby properties after the implementation of the proposed changes. 3. The Board notes that the requested variances are substantial, but this is mitigated by the factors described above. 4. This variance will not have a significant adverse physical or environmental effect on the neighborhood or district. The proposal will reduce the total covered porch area compared to the existing condition, and permeability will meet the district requirement. 5. The alleged difficulty is self-created insofar as it is motivated by the applicant's desire to replace an existing wraparound porch with two smaller porch areas and add"eyebrow" covers over existing garage doors, but this is not necessarily fatal to the application. Cohen,) RECUSED: NAYES: This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per the Unified Development Ordinance.
